Well it has been almost 30 days since i disputed online derogatory items on my credit report, with all three bureaus. I'm trying to figure out my next step of action after the 30 days is up. Should i call the bureaus and threaten them saying that they are violating the FCRA and have this removed immediatly? or should i send them a letter stating that i will take legal action if these incorrect items are not removed? Thanks for the advice.
Remember that they have 5 days after the investigation to get you the results. That being said, I'd call them at the 30-day point and ask for the results. I did this on many occasions and they gave me the results and the date the updated report was mailed or being mailed. If they didn't delete the items you disputed, start the validation process with the CA. Save the law quotes and legal threats for later. The CRA reps don't know or understand the laws. They are hourly droids, nothing more. If, after the validation process, you need to get "heavy", take a look at who might respond the best to law quotes and threats of legal action. BTW, if you threaten legal action, be prepared to follow though with it. Remember, you really don't want them to validate. You want them to break the law and do it in writing so you can go after them it court with a documented paper trail. They may be difficult, stupid and controlling at times, but I've found that being civil, kind, professional and upfront goes a long way in dealing with them.
Smogtek, Thanks for the reply. Since i'm really new to this stuff, could you point in the direction for the steps in the validation process. I'm not sure of the process on doing this. Thanks,
Start by reading the FAQ section at the top of the board and check out the sample letters section for the validation letters. You may need to adjust/edit them to suit your individual situation. Best piece of advice: Know WHAT & WHY you are doing something BEFORE you do it!
