Anyone have any comments, opnions, recommendations on/about The Fair Credit Movement (faircreditmovement.org)?
She supplies a lot of examples where she "angrily" wrote this letter and that letter, yet there are 0 results. Most of her points are correct but I spotted a couple of places where she quoted sections of the FDCPA that were incorrect because of how much time had lapsed.
She is also giving out inaccurate answers to legal questions, Mr Alan. You have asked the same question, about credit card accounts being open or written in Louisiana, on a number of boards, that I've seen (at least I think it is you, LOL, they are all using the name Alan). Anyone who says that credit cards are always considered open accounts in every state is mistaken, and should not be giving legal advice. I trust she has a disclaimer somewhere or she will end up getting sued one of these days. A lot of the advice there is good, this particular tidbit is not. I know I posted on cardreport.com message board that the best thing to do is ask an attorney who practices in LA. You can act on this gal's advice if you want to - but don't be surprised if you get caught in a mess, because it simply is not clear in the Louisiana statutes, and you need to find out how the courts there have ruled, rather than get an opinion from someone who actually seems to know less than you do at this point. Owning a website does not make a person an expert!!
I agree with the inaccurate information, I perused the site and saw several things. This in particular stood out to me: "Did you know that as long as you are making payments on an account to a Creditor that they CANNOT turn it over to collections or pursue a judgment against you? If they do, it will be dismissed by any judge in the country! How do I know this? I've done it and am still doing it." It is a wholely inaccurate statement. A court MAY acknowledge the fact one is making payments, but that does not necessarily mean they cannot get a judgement or turn it over to collections.
Yeah, I saw that. Interesting concept. Practices vary by court and even by judge, hehe. We have one judge here that would probably hang "deadbeats" (they won't let him, though). LOL Somehow, folks think, "If it appears on a website, it's true."
