I gave Sears until today to get that inquiry off my report and they didn't even acknowledge my correspondece, other than I the green card I received back. The inqiury is still sittin' on my report.

So I guess I need to file in small claims court on Monday. Some might think this is ridicules, over an inquiry, but I've been jerked around by Sears since November for various things and I've had it. If I can make them pay for their lies and false reporting, than I want to do that.

Now, anyone in PA?? I'm a complete idiot and have no idea where to start. Are small claims handled through the district justice's office? Or do I go down to the court house and file? And what the heck is a serving agent that everyone keeps talking about?

I need a Dummies Course here... can anyone help me? I've done searches and that 'serving agent' keeps coming up and that has me confused... is that just for federal court or just small claims?

    O.K Ozzy here goes:

As best as I can tell you need to go down to the courthouse and subit your claim to the small claims court. the clerk will give you a court date and time and you can choose to hire a serving agent or send a copy via courier to the representative for sears in your state or to the Attorney generals office who woould then send it to the right party. You can check the Pennsylvania State Attorney Generals website for further info regarding this matter. It should help alot.

Hope this helps. There are several people on this board who are far more informed than I am and I'm sure they can provide you with even more details.
