WHAT IF A 3RD-PARTY COLLECTOR BOUGHT OUT A DEBTOR'S ACCOUNT AND THEY NEVER CALLED OR CONTACTED THE DEBTOR TO TELL THEM THEY NOW HAVE THE ACCOUNT. AND AFTER 11 YRS ALL OF A SUDDEN THE 3RD-PARTY IS TRYING TO COLLECT ON A JUDGMENT WITH INTEREST FOR 11 YRS. IS THIS LEGAL OR ILLEGAL
Sounds like something Asset Acceptance would pull. Are you sure it's a Judgement? If yes, check out teh SOL on Judgements in your state. If not, check your state's Statute of Limitations on the type of debt it is. If teh debt is out of Statute, tell them to pound sand. If not, search for a thread I posted last year about making yourself Judgement proof. You will need taht info
this was something that stryker collections pulled. it was a bank loan 11 yrs ago for a Quad. It was stolen and the bank was paid off by the comapny that sold the Quad. After that Stryker collections puy a judgment on the credit report. no one was notified of this information. Now the debtor went to apply for a mortgage and a 3rd-party attorney bought out the account, but never in 11 yrs tried to contact run a credit report to find the debtor. now the 3rd party wants to collect on the org debt amt and 11 yrs in interest.
Re: Re: Third Party Collectors No one was notified of the judgment? Maybe there are grounds to have it vacated for improper service. You need to get the court documents and check. This is the usual scenario, they will lay low until the debtor attempts to utilize credit / mortgage
