Re: email, Trans Union I spoke with Mr. R. Stuart Phillips again and he is interested in possibly taking over my case. I sent him copies of everything pertaining to the case by overnight mail today, after spending an hour at Mail Boxes Etc. making copies. Still no update on whether the court is going to ok the request to transfer to federal court or not. The clerk last Friday told me it would be done within a day or two. The court clerks claim there is nothing in the file showing anything was signed by the judge. But, with federal court clerks still claiming it was transferred, I'm beginning to wonder if the clerks at Justice court maybe misfiled the paper work. Well, in any event, if they don't send a minute entry showing it was transferred, I will assume I'm dealing with justice court and not federal.
Re: This board being watched? LKH: I thought about sometime last night.... Have you checked your credit report lately? They should have marked that the tradelines are being disputed/under investigation. If they didn't it would be another violation right?
Re: This board being watched? Equifax has always marked my disputes as consumer disputes - reinvestigation in process. Experian has never to my recollection, listed accounts as in dispute. Also, I disputed several times online thru creditexpert, and never got an updated report in the mail. Just the email notice that the investigation was complete. I wonder are they supposed to leave the notice that consumer disputes even after their investigation if the account gets verified. Now, as far as Gulf State, those crooks are reporting after receiving both a validation and an estoppel from me and they still haven't responded. They are required to put the notification that consumer disputes and they also are not allowed to report any part of the account that the consumer disputes until they validate. I've got them on a ton of violations. I'm waiting to hear from R. Stuart Phillips as to whether he is going to take my case. We may file against gulf state also.
Re: This board being watched? Hey.... Just wanted to say that I hope you take Gulf State to the cleaners! Hang them out to dry! I have been doing some research on collection agencies, their tactics, etc. and Gulf State is the NUMBER ONE hated collection agency of all time (next to NCO). NCO was on my BACK when my student loans were in default. Looking back on the matter, I paid NCO money until my loans were consolidated (maybe 2 or 3 payments) and I don't think they ever applied any of that money to my accounts. How do I know? Because the defaulted amounts on my credit reports (3 total) added up to my beginning loan consolidation balance. So where did the money I paid NCO go??? *sigh* I could pull out my financial records and investigate but at this point, the effort isn't worth the time.

Re: This board being watched? When I bought my house it was a 'relo' situation, meaning the house was build and being set up for an executive of a local corporation. They transfered him before he even got to move in. However, they had already started setting up the utilities. Cable had been installed and there were two cable boxes in the house. I don't use cable, I use satellite, so I just put them away. Anyway, about 6 months later I notice a collection on my Credit report. NCO for charter cable. $750.00. HUH? I called them up to find out what was going on. They had been 'trying to reach me' and had 'sent several letters'. I don't think so. The collection was for installation of cable and two boxes at my house. I explained to them that I never ordered cable, that I had had satellite for years, etc. The rep actually said to me "Stop lying and just pay your bill. You are going to have to be a man sooner or later". I called him a telemarketer and he hung up. I called back to explain again amd was basically told not to call back until I was ready to give them a credit card number. I gave up on them and went to the source. Charter cable was very apologetic and immediately faxed a letter (in front of me) to NCO and gave me a copy. The collection was still there two months later. I called Charter and they faxed it again. And again. Nothing. Finally I called Charter and refused to hang up until they called NCO to get status. The Charter rep agreed and put me on three-way as she called NCO. The woman at NCO was VERY rude to her as well and when she found out I was on the phone she had a fit and transferred us to the supervisor. The super told the charter rep she was NOT to call with customers on the line but agreed to fix the problem. She denied that any fax had ever been received regarding my 'account'. I got a letter in the mail 2 weeks later from NCO explaining that mistakes happen and it had been removed. What a bunch of jerks! Shawn
Re: This board being watched? NCO and Gulf state - top of the line when it comes to violating the law. Gulf State has actually been in trouble with the FTC before, if I remember correctly. In fact, in one of my letters to gulf state, I mentioned the fact that I was aware of their illegal collection tactics and the FTC problems they had in the past and that it didn't appear they had learned anything. I told them they could count on me to refresh the FTC's memory.

It seems to me you have them dead to rights on several violations of the FDCPA. read these sections very carefully: It's almost hard to count up how many separate instances of violations you recounted in this one post. I counted at least six. AND, you have a disinterested witness (the cable company clerk(s)) that can testify to at least some of the events, thereby lending credibility to your entire story. Why not sue their a$$es just for practice? At $1000 per violation, plus punitive damages if you have a sympathetic judge, might be worth a day of your life.
Re: This board being watched? Same here with EQF, but EXP has always marked the account "This account is currently being investigated." I couldn't remember who your lawsuit was against, but if they were not listing "dispute/investigation" etc. I think it's a violation since they know they are in dispute. As for as markers after the investigation is completed, they don't have to, nor do they. If you immediately started a new investigation, it would be required to be marked. Trying to help! There's been no legal action against me, but, the author of the letter has been very helpful to me in removing a couple of the last remaining derogs and adding back in my car loan. He even called the creditor for me to get this straightened out. How's that for a threat.
