    So while we are bumping, maybe LKH will come in here and tell us if there are any new updates on his court situation.

    Anyone checked out bayhouse.com lately? Seems Christine got a letter with an offer to settle from Experian!

    Hey guys, I appreciate the interest, but, unfortunately I have nothing new to report. Still no word from the court as to whether they will approve the transfer to federal or not. The clerk said by the end of the week. I won't hold my breath though. Also, R. Stuart Phillips received my package of copies of everything pertaining to this case. He is looking it over (taking his time I might add). He said he'd let me know soon whether he'll take it or not. Don't worry, I'll let you know as soon as I know.

    I got the news today that the justice court judge denied my objection to transfer to federal court. The minute entry only says "as mandated by statute" the case must be heard in federal court. I called to ask what statute the judge was referring to, and the secretary said the FCRA. Now, if that is the case, that is the biggest crock. FCRA says "an action filed in re:to FCRA may be filed in federal court without regard to the amount in question, OR ANY other competent court of law. Pure B.S.
    Also, as far as Mr. Phillips goes, he has not gotten back to me as promised, so I guess he's out of the question as far as representing me. Maybe I should just drop the case. What do you guys think?
    Oh, and as far as the poster known as delete, his grammar, spelling and nonsensical posts make me think he is none other than our old friend Bobby.

    I would not drop it. I'd get on Yahoo or one of the search engines and type in David Szwak and drop him and email or call him and see what he has to say. And if you don't like him for whatever reason, look around here on credit net and pick up on another one that's recommended by several people a while back.

    See what a specialist in the field might have to tell you instead of just any old lawyer.

    I don't think I'd want to drop it and run until I had talked to a specialist.

    Good question. Haven't heard from him in 2-3 weeks. No response to messages. I guess I'm in the market for a lawyer.

    Not a coincidence. I had determined last spring that booby lives in my city. I know where he works and I know his full name. Thanks Mr. Detective. LOL

    It should be an easy matter for you to get the case papers if he will give us the case number.
    That's if you want to and he don't.

    No, I would not drop it, but I would try a visit to the courthouse with a copy of the FCRA and an appointment with the judge.

    Did you search bayhouse.com for Christine's suit? Why do you think they're settling hers? $$ figure? Local affiliate or national issue?

    While you're searching, try Randolph "Rand" Bragg in Chicago. There was an article in one of the Collections Worlds how he's on the Top 5 list of lawyers they recommend companies stay away from because he's so good.


    7000 club... here we come!

    I have not done a search at bayhouse. Was hers a local affiliate?
    My suit, since it was filed in small claims, asked for $2,000. In fact, because the amount asked for was so small, the defense also asked for arbitration after the request to transfer. Not sure if you were asking me, but it is the local experian affiliate.

    Ok LKH, I did not read all the threads, but I cannot believe that TU is going to pay an atty to go into federal court to defend a claim for $2,000! It is cheaper for them to pay and delete. Everytime I think I have heard it all...

    Could be thay are trying put out all the small claims brush fires! If they can do that they won't have to pay or delete ever again.

    The lawsuit is against credit data southwest, the local experian affiliate. I also sent them an offer to settle - no money, just delete a few items that they committed violations on and I will drop the suit. I guess their answer is no. Ok. the fight goes on.
