Re: email, Trans Union LKH: I haven't read everything you posted but having said that...in my opinion, if you have only been exercising your right to Freedom of Speach and not libeling them (which I sure you were probably just posting your frustrations/experiences with dealing with them) they wouldn't follow through because there is nothing that you have done wrong. I can't imagine the outpouring of support from consumers you would have if they tried to "sue" you for speaking the truth. I liked Marie's post about what that would appear to look like to the rest of the world! I believe it is their attempt to intimidate you into being quiet out of fear of what they might do to you, hoping that fear will silence you AND others. I wonder if that letter could be interpeted by the laws as a threat or even harrassment. I would definately ask a "consumer" attorney, specializing in the FCRA, about it. Don't let them steal away your rights as they do our identities. As I said before, it's ironic that they feel threatened by our speaking the truth yet they feel no remorse for publishing mis-truths about our reputations. LKH, Keep excercising your RIGHT to speak out the "truth"!

I applaud your tenacity Mr. Fisher, I don't know if I could ever muster up the type of persistence necessary to communicate with these folks.. It seems that e-mail is an effective tool in your quest for answers. It would drive me crazy using it as a medium for communication with these clowns. I would like to depose them personally and then screw them in court... There passive-aggressive behavior kills me.

As most around these parts are aware, I'd rather just go out and dump those kinds and get on with the next show whatever that may be. That's also why I have little or no patience for fooling with the CRAs in the first place. I'd rather just have them beat going in the door and be done with it. You got to admire them though. They are slicker than a greased hog at the county fair.

I mean, in the last 5 or 10 posts on this thread I fail to see one single thing that has been said that would be worth two whoops in Hell since 09/08/01 meaning that this thread has been going on for over 10 days now without anybody having said anything that has much resemblance to lucidity.

Re: email, Trans Union In the 3 weeks since I received this letter, 2 of 3 complaints I had with TU have now been corrected. My car loan, that they deleted, they reinserted. But, it showed 2 times 30 days late as before. That was the reason I disputed it. It was never late. So, when I saw the lates, I called the person at TU. I had him call the creditor and it has been corrected. The 2nd item, a collection, was deleted. The final item, is the chapter 13 bk that I filed, but didn't go thru with, now says is reported correctly and will stay for 7 years, which means I have 4 1/2 years to go. I can't find anything in the FCRA that deals with bks that were filed but dismissed. Anybody know anything about this? And finally, my lawsuit with Credit Data Southwest has been transferred to U.S. District court. I gave my atty the go ahead since the atty I was referred to never got back to me, and I don't have time to waste as the case is in progress. PS - I couldn't let this thread die.

Re: email, Trans Union LKH, I know I have heard others say they have a "dismissed" bk on their reports. People also have disimissed lawsuits, and suits where they were the ones suing (and won!!) all being reported as derogs. I was all set to take on TU when my judgment was vacated, because I fully expected them to report it as a "vacated judgment" - (I had faxed them the court order.) They deleted it, and so far it has stayed deleted. I guess the legal status is different, I dunno. Since you are going to court, why not include this? Has anyone ever researched to see if there has been any kind of prior ruling on "dismissed" cases reported as derogs? If not, you could be the one. My beef (see the other thread) is that any court record is reported as a derog, no matter what it is, so you are penalized by the credit system for using the court system our country provides!! This seems like a constitutional issue to me, with my simple little non-legal mind. I agree with you about the lawyer who never called you back - who needs it? They can be the very best in the world and if they aren't accessible, what good is it? Please keep the thread going, LOL. It is a great discussion!! Shades of John Grisham
