Re: email, Trans Union Well, things are developing in a big hurry when it comes to the field of lawsuits. There is still much to be learned but I am rapidly closing the gap. I plan to be working with an ex-attorney in Phoenix very soon to develop some videos which will show us how to go to court, file for motion to dismiss pro se and win the case. I worked with this same attorney several years ago when my son-in-law was in the process of getting deported to Mexico for a drug related felony he got himself mixed up in. I'll call the attorney Bob because that's his nickname. Bob doesn't do immigration cases but he referred me to the head professor of the Texas A&M law school who referred me to an attorney in Loredo where my son-in-law was then incarcerated in the INS deportation center. That attorney told me about a bonding company in Dallas who bonded my son out and we went and got him out of the detention center and then back to OKC where he could get a fair deportation hearing. Doing that was considered impossible by all the immigration attorneys I had contacted previously. They all said that getting him bonded out was impossible and that I should not even consider trying it because it would only lead to grief. Bob and his acquaintances saved the day and my son-in-law is still here in the US and now has a beautiful family. Had it not been for Bob, I would have virtually lost my grandchildren to Mexico since my son-in-law would never have been able to return to the US. Bob and I had worked on some other things back in the days of the BBS and the old 147 net when I ran a BBS which I used to further a lot of political agendas such as the 10th Amendment movement and the nationwide fight to defeat the CON-CON or constitutional convention which was being promulgated by the Organization of State Legislatures nationwide. This was designed to meet in Philadelphia as a new constitutional convention to permanently change our constitution to concur with the U.N. Charter. In that effort, I worked closely with then Colorado State Senator Charles Duke and California State Senator Don Rogers and we beat the idea of the CON-CON by denying it enough delegates so that no quorum could be established. Bob is pretty controversial and has a lot of great ideas that conventional lawyers don't like. I think that the outcome of this collaboration will be a video or series of videos which will teach us how to go to court, what papers will be needed and how to fight in court as a pro se litigant and win, thereby getting judgments reversed through motions to vacate and other tactics. I can't tell yet how long it will take to produce the videos and have them ready to go as part of the creditwrench™ program. It may only be a few days or it may take much longer. But the outcome should mean that much of the confusion and lack of knowledge on how to proceed will be dispelled forever.
Re: email, Trans Union Jim, as far as Lexington goes, they did 1 round on experian (credit Data Southwest) for me. They disputed 1 item (per experian) which was deleted. Lex's email to me shows several others that were disputed???? My rep from Lex has been in contact thru email and when I have called Lex, he has promptly called me back. However, all my disputes with exp. are on hold now due to the lawsuit. As far as Equifax goes, when I cancelled Junum, I continued disputing myself and have great success in removing the last difficult items. my disputes must have triggered something with Gulf States, as they reported something to equifax during the verification period. I sent them validation letters which they have not responded to. On Sept. 18 I sent Gulf State the estoppel letter. I gave them til yesterday to remove the derog. I'll call equifax tomorrow and if it's not removed, lawsuit #2 will be filed at that time. No more BS from these schmucks. Trans Union - well, you know the story but only a couple of minor things left with the exception of that bk 13. By the way, TU is the only one reporting the dismissed bk, the others removed it.

Re: email, Trans Union Breeze, you know what really sucks about this dismissed bk, is that I had a lawsuit against a ripoff company, and I lost. Out of spite, I said screw this and went and filed the bk 13. I then negotiated a reduced settlement. I never paid the filing fee and had them pull the papers immediately. The judgment did get reported, but has been removed from all 3 bureaus. But, TU will not delete it.
Re: email, Trans Union Not real sure, LK because I don't know the exact circumstances of the situation. You can either post it or email me and let me see what the details are. Do so even if we have discussed it before because once I get something figured out or responded to, I'm off to the next problem and done forgot about the last one. I have so many irons in the fire all the time that I simply have to operate that way. Get one problem solved or whatever and move on to the next one. I usually have to just figure out what I want to do or want done and have to relegate it to someone else to actually do it. Anyway, lots of "new to me" info is coming my way all the time and so what I said I didn't know anything about yesterday, maybe I do today or will "tomorrow" A prime example of that is what I have recently learned about the Spears case and how it affects validation. I sure do wish I could come across Court decisions like the one in Spears from the Indiana Court of Appeals more often. That thing is a purple people eater for sure. Life's like that, I guess.
Re: email, Trans Union Do you have copies of the papers the court has on record? Or have you checked to see what is on the court record. I know with my judgment, it was partly the court's fault - they misplaced the paperwork!! Inaccurate court record. No kidding. How do you sue a federal district court??? LOL
Re: email, Trans Union Breeze, I have called the court's automated system. It shows as filed in June, '99 and dismissed July'99. But, it then goes on to say the meeting of creditors was held on such and such date, etc. There was no meeting of creditors because there was no bk. The clerk said the reason it shows as that is because all the court dates were set prior to the dismissal. What a crock.
Re: email, Trans Union Look what I just found under section 605 of the FCRA d) Information required to be disclosed. Any consumer reporting agency that furnishes a consumer report that contains information regarding any case involving the consumer that arises under title 11, United States Code, shall include in the report an identification of the chapter of such title 11 under which such case arises if provided by the source of the information. If any case arising or filed under title 11, United States Code, is withdrawn by the consumer before a final judgment, the consumer reporting agency shall include in the report that such case or filing was withdrawn upon receipt of documentation certifying such withdrawal. The only notation made on this listing is dismissed. It says nothing about the case being withdrawn. I wonder how far I can get with this.

CREDIT BUREAU INC., 734 F2d 37 (D.C. 1987) Credit reports containing factually correct information that nonetheless mislead their readers are neither maximally accurate within meaning of Fair Credit Reporting Act nor fair to consumers who are subject of report.

I just saw the references to it in a search engine type of listing amid a whole webpage of different cases So it looked like it might have some bearing on your situation, so I cut and pasted over here. One of those "Hey, that looks interesting type of thing." Where to find it? Maybe Lawdog or Nolo or one of those. You will just have to go hunting through the legal search engines just as I would.
Re: email, Trans Union I have a bunch of completely disjointed notes on laws and links at the following urls. These are not necessarily related to credit repair, but are just stuff that we are looking at for possible inclusion in the videos we are producing to teach people how to go into court and win. Some of these links may have to do with IRS tax cases and other things as well since that is also of great interest to me. Therefore you will even find a few that will deal with criminal cases and dealing with IRS too. But you will have to remember that these are just things that we are looking at for possible inclusion. There is also a couple of pages of links to legal research sites that may help you in finding case cites that you may be interested in. But it's all pretty random as of yet and has not been put into any semblance of "lucidity" or correlation to what we are actually doing. We had to do it the same way when we put together the CD on federal law which we are currently marketing to attorneys who can put the cd in a laptop or whatever and have a complete law library of federal statutes and court decisions to work with in court or wherever and have it all at their fingertips on one CD. You might find some of them useful since they do deal with US Federal court and the federal system as well. Rules of civil procedure and lots of stuff on these webpages. Just hope they will do you some good.
