this is bad - lawsuit

    While I was at the YMCA, a deputy stopped by my house to serve a lawsuit on me. He left me a card saying I should call to arrange for a time to be served. I called and he will not be in until tomorrow.

    I have no idea who can be suing me. Everything is current and up to date. No defaults. There is no reason for anyone to sue me at all. I will be up all night worrying about this.

    I don't need this. I checked all my creditors online and all show me current. Next step is to check my Equifax report and see if anything negative popped up since I checked last week.

    Have you moved recently? Old landlords have a tendancy to do this type of thing.

    Have you checked to see if you can go by the sheriff's office to pick up the summons? In our area they routinely give you the option of coming in and picking it up rather than being embarrassed by being served at home or at work.

    Maybe at least if you can pick it up you won't have to worry all night.

    I have not moved in over three years. I had a written agreement with the realtor when I moved. If I did certain things (primarily vacate the premises by a certain date), she would pay me $1150. I moved on time and she gave me the check.

    I can't pick it up at the sheriffs office because the deputy has it and he is out serving people now. He won't be in until tomorrow morning.

    Are you sure it's a suit, and not just a summons? Maybe someone wants you for a witness?

    Did you do it with a mouse?

    Did you do it with a gun?
    Did you bribe anyone?

    Did you wipe off all the prints?
    Did you mop up all the hints?

    Did you follow any plan?

    I don't know about where you live, my way though, the deputies don't serve suits. The magistrate court uses a contractual process server and the jp court uses the constable.

    I hope you're not up all night worrying, but I can't say I'd do anything less and am hard pressed to come up with anything that will likely take your mind off the issue at hand. Really though, it's out of your control until tomorrow whether you worry about it or not.

    You could see if Dave will stay up with you, the two of you could make up rhymes ;-). Sorry, I know your issue is serious and he was diffusing; Dave had me ROFLMAO.

    I was not making fun of him...only light hearted fun of the 2 posts before mine...Sarcasm is difficult to print in words :) If it came across as a real post asking him to answer those questions, it should not have. I can tell he is worried about this, and I would probably be up all night too.

    Im asking about the car accidents because I used to work in the fraud unit of a large insurance company. People will sue nowadays if you even so much as tap the back of their car at 5mph. I used to get literally dozens of calls on a weekly basis with people hysterical, because they got served with a lawsuit over an accident that they thought was just a fender bender. We were instructed to tell our insureds to contact us immediately if they were served with a suit. Its just something to think about, in all seriousness

    Thanks for the humor. I try not to take things too seriously. I did stay awake most of the night worrying about this. I had two serious illnesses over the last few years and ran up about $150,000 in doctor and hospital bills. My HMO had a policy of always refusing to pay. I then had to dispute the refusal. When they finally did agree to pay, they frequently lied, saying they had paid when they didn't. It was a nightmare. I was sure that this must be some doctor or hospital suing.

    I got thru to the deputy at 7:45 this morning and he told me what it was. My dad died 1 1/2 years ago. My brother decided to sue the nursing home for negligence. He did it on behalf of the estate. Just didn't tell anyone. So, because it was my father, they had to give me notice. I was not being sued, just notified of the suit. I'm not sure why they used the sheriff. Maybe because it was from out of state.

    It depends on where you live. In FL you can use the Sherriffs office or you can find and use a process server.

    It's alot easier to use the sherriff's office since they usually have an office in the courthouse. That's why they probably used the Sherriff's office.

    I am sorry about your loss. Though it was over a year ago, the loss of a parent is a huge thing to go through.

    On the other hand, I am glad you have nothing lawsuit-wise coming your way. Your first instinct was best, you knew had nothing delinquent and no one should be coming after you.

    Anyway, I am happy for you and sad at the same time...things like this are sometimes an "omen" to call your brother and talk about the good times with your dad.
