I sent out a validation letter to a ca who was trying to collect a balance from a credit card account. A few weeks went by and I get this call from this guy from the ca stating that all I have to do is contact the original creditor and they will provide me with my signature. I promptly told him that it is not my job to validate my own debts and the he would have to do this if he wants to get paid. Anyway I sat and argued with this idiot for 15 minutes until he finally hung up. My question is am I right when I told him that I am not required to contact the original creditor to obtain verification? THANKS FOR YOUR HELP ITS APPRECIATED
Yes, you are right. You sent the validation to a 3rd party collector, who must get the info and send it to you. However, I would have never had a discussion with a collector over the phone. If they call back, tell them you will only communicate via mail and hang up. When it hits 30 days and the ca hasn't sent you the correctly validated info, send out the estoppel, certified mail r/r/r.
Thanks LKH i will take that advice. Talking to these idiots doesnt seem to get anywhere you hit them with common sense and all they do is talk jibberish
One more thing, the ca is in violation of the FDCPA for contacting you after receiving the request for validation, IF you sent the request within 30 days of their initial contact with you.
