    actually they are not suing me.........i should have clarified that.........but anyway...it is off to court.

    i know it sounds as if i don't know what i am talking about....actually i filed my answer and did a motion to dismiss...thus the court date. sorry for any mix up

    But they're still suing you. You have filed a motion to dismiss their suit, but it hasn't been acted upon. So they are still suing you until it is dismissed or withdrawn.

    sorry for the mix up............the way the lady explained it to me on the phone is by my filing the motion......i am the one who initiated the court date.......so regardless of what happens....i will have to take everything with a grain of salt. sorry hiding for the mix up..........sorry hedwig.

    I think you initiated a court date on the Motion to Dismiss but the original suit still exists until that Motion is heard...but I'm getting confused,

    I have hiding's headache now.

    I agree. Just requesting a motion to dismiss doesn't make it dismissed. I bet if you didn't show up to see if the dismissal was granted, they could still get a summary judgment.

    i did receive a summons..........but after that.....nothing...as far as a letter being sent out to me about going to court.......nothing...i had filed my answer along with a motion to dismiss and then i receive mail saying there will be a court date......thus talking to the lady and she told me that i initiated the court date, not them. also this validation was made a LOOOOOOOONG time ago...but i had made photocopies of everything from day one......i moved and couldn't find my file of originals.....thus the photocopy of my green card with.

    They do however, have to report the account as disputed to the reporting agency if they report it after reciept of ANY validaiton request, expired or not.

    You can sue them for the amount of the debt.
