i just got done online with exp. i have about 7 accounts that are included in a BK from '98 that are showing up. what concerns me is one from sherman acquisitions, says i opened an account 9-02, have a 3K balance and filed BK 12-02. this is too weird! this is not mine. now that i am calmer, i am thinking that this is an old acct. sold to them. disputed with exp as not mine/no knowledge of acct. also says OC is Metris, no idea who or what they are. sheesh, the things that can go on your report without your knowledge though. also i have 2 hard pulls from the credit union who financed our vehicle, first pull 3-19, second one a month later. i am not on the loan. why did they pull it, and why did they pull another one a month later, and do i have any recourse? i was told when i was talking to them and giving new address that since i don't work, i can't be on the loan. what is this stuff?
just pulled out credit report from 5-01. i found the offending acct. this was a direct merchants visa. says acct. scheduled to remain on till 5-2002, yeah, then they sell it and it will go on my credit report as a collection. also clearly says debt included in ch 7 bk. why would they sell a bk discharged debt and report it? i don't get it.
You need to immediately send Sherman an intent to sue. Advise them this was included in bk and the 7 year mark for reporting this was up a year ago. Tell them they are in violation of Federal BK laws as well as the FDCPA. Give them 10 days to send you a copy of the UDF that they sent to the cra's to have this removed. Tell them on the 11th day you will file suit. It will never get that far. These scumbags buy the bottom of the barrel debts hoping the consumer doesn't know his rights. They'll fix it. They usually do very quickly.
