I just asked for proof of a deb that isn't mine!! The OC sent an application with a signature on it that is NOT mine. What do I do now? I have read on this site that it isn't a good idea to sign the Affidavit of Forgery that the OC sends because it can put a fraud alert on your credit report that does more harm than good. What are my options here?
It sounds like you really were a victem of fraud and/or identity theft. If this is the case, then I would not only sign the Affidavit of Forgery, but I would also file a police report. It can be a pain to have a fraud alert on your credit report, but if there really has been fraud here then it would probably be a good thing for you... hopefully it will stop anyone from opening more accounts in your name. People here will often claim an account is not theirs in hopes that a creditor or collection agency can't prove that the account really belongs to them. When someone does this, then there hasn't really been fraud and they don't want to go through the hassle of having a fraud alert on their file. (Nor do they want to outright lie on such a document). I think that's why people typically recommend against signing the document. HTH, Brett
I just don't want to sign it just in case it is mine. I had a loc account that was sold to some other bank but the statements still come in the old bank name and the balance on this account doesn't match what my balance is on the sold account. I have also read alot about fraud alerts being put on your credit report and I definately don't want that. Any other options here? I read a post that Butch had replied to saying to send the affidavit back with a letter, but I can't find the post anymore.

[/color] About the application that the OC sent to you - does all other information match? Is it with your name, address, etc.? Call the old bank and try to get a phone number for the new bank, so you can verify the account number.

Hain't Mine!! "IF" they put a FRAUD ALERT on your credit reports under "CONSUMER STATEMENT"---you should be able to have them REMOVED immediately because it is NOT YOUR STATEMENT!!! Unless you really want it there...
Re: Hain't Mine!! The SIGNATURE on the app isn't mine. I am not sure if the ACCOUNT is mine or not. Read my previous post about the loc account being sold. I guess the first sentace should have been "...debt that I am not sure if it's mine" What??? I not quite sure what you are trying to say here.
