Susan Wrote==> earlier... in the posts you wrote about trucredit merged credit reports that you check from. I am looking for a way to check my score often but without actually lowering it? Is that a small fee for an amount of time that you can constantly go back and update?

I use Truecredit for 9.95/mo. I can update everyday and I usually do. These are soft inquiries that have not bothered my score.

ONTRACK WROTE==> Did the CRA remove in response to a dispute thru the CRA, or in response to a dispute with the CA?

Equifax removed the derog in response to a dispute from me to Equifax. I can only assume this because I sent three letters to Equifax. One before iI disputed with CRA and two more after receiving the letter from Arrow Financial stating that they would instruct all CRA's to delete. I waited 30days plus between letters. They finally deleted after I sent an ITS.

ONTRACK WROTE==>If they removed due to a CRA dispute, then they should also have sent you notice on reinsertion, and they should have required that the CA specifically "certify" the accuracy before reinserting, as per FCRA.

This is exactly what my claim is based upon. I have no communication from them on reinsertion.

    How can you prove damages?

How can you prove you have had to pay higher rates as a result of their error?

Do you have an adverse action notice from a creditor, indicating that they pulled Equifax in deciding to either deny you credit, or give you poorer terms?

Does it check all three credit bureaus and give you scores? It only says transunion and doesn't say anything about scores...

It does all three, but the scores aren't accurate. I've compared them to pulling all three scores from MyFico.com. They're off, but they're a good baseline to go off to see if your score is going up or down, not necissarily the accuracy.

I use TrueCredit and love it. It's a good investment.

    Update on my credit issues

Back in may of 2006, I filed a small claim against Equifax Information Services, LLC, ET AL for violation of my civil rights under 15 USC 1681i. Specifically for reinsertion of a trade line item that they had deleted from my credit report.

This item was deleted because of evidentiary documentation (copy of which is enclosed here) that I had provided them. We eventually settled out of court and the item was deleted again from my report because of the terms of the settlement.

Equifax claimed during my negotiations with them that they were only the providers of the info and that CSC Credit Services was the party responsible for maintaining the report. I bought this line from them, I believe mistakenly. See United States Court of Appeals for the Fifth Circuit Kenneth M. Morris, vs. Equifax Information Services. LLC, ET AL No. 05-20578.

I then contacted CSC Credit Services about the violation of 15 USC 1681i with my report and also addressed at that time some other inaccuracies with my report. They referred me directly to their outside counsel. Their outside counsel worked with me on my report to see that it was made accurate but dismissed my monetary damage claims out of hand. Also, after I formally requested money damages with a letter to their outside counsel, my report was taken to off-line status to where me and my banker could not access it. I have not brought legal action against CSC to date. Sometime in December of 2006 my report was once again available to view.

I am still considering legal action against CSC Credit Services and was going to file on them this month when my business slowed a little. However, this is where it gets complicated for me. In December 2006-January 2007 when I was able to access my report once again, there it was, the trade line that I disputed and sued Equifax for in the first place. I have already checked with the company listed in the trade line and they informed me that they were not the providers of the information for this item to be listed again. They also expressed to me that the account was closed.

My question is this, where do I go from here? I do believe that there is the potential for summary judgment in my case if brought forward. Any one's opinion is welcome on the possibility of money damages at this point. I have just retained an attorney to look at this situation.
