Three violations I believe.

Just a bit of bakground I recently got all of my reports and found one burea had my middle initial wrong along with several medical collectrons from a state I have never been to in my life. I decide to begin disputing the obviously incorrect collections accounts. So I sent dispute letter to the CRA and and validation letters to eight different CAs on these medical collections. To date I have recived the green cards back from the CRA and two CAs.

Today I received a collection letter from one of the CAs that I have a green card back from trying to make it look like an offer to settle. The letter does have the part about this is an attempt to collect a debt however not one thing about my right to 30 days to dispute. It also says I have 14 days to remit half the alleged debt or they will withdraw the settlement offer.

Am I correct that this would be three violations?

One for attempting to collect before they provide validation.

One for not informing me of my right to dispute the debt.

One for the 14 days to respond with payment?

Yes. That is 3 violations since they sent this after they received your validation.

I had/have a fairly similar situation with a supposed collection agency over something I have no earthyl clue what it was for. Was the first time I ever got anything from this place, they wanted to settle for a certain amount. They gave me ~7 days, no mention of ANY kind of validation and no mention of my right to dispute. That's the same 3 violations you mentioned in your case. I've got about 10-15 more days for them to send me anything back under the 30-day deal, if they don't I am seriously thinking of slapping 'em with all three FDCPA violations @ $1,000/ea.

I've always been a little scared about even small claims court though, anyone been there and done that and have any advice should I proceed down that path?
