As some of you may recall from my other threads, I want start the validation/ dispute process for a collections tradeline that is on my credit report. Before doing so, I want to get my old addresses removed. I disputed the addresses with Experian over the phone. They sent me a new credit report that still had old addresses on it. I disputed the same with TU online and the response I have received is a dispute confirmatin. I haven't disputed with Equifax yet. I'm going to law school in August and want to get my application into the apartment complex where I intend on living. One of their leasing representatives mentioned that an open collection would result in an automatic rejection. At the least, I wanted to have the collections item in dispute at the time I applied, but it appears the CRAs are dragging their feet/ giving me a run-around. How can proceed with the greatest chance of success in getting the collections account removed, while also being able to apply for my apartment complex shortly? I'd like to apply in the next week or so. Thanks for the advice.
Here's a thought... If you follow the send CA validation letter, and when green card is returned dispute process, maybe the address won't be an issue. Because - once you send the validation, in theory they cannot verify its accuracy with the CRA. One of two things can happen. They will mark it in dispute (which is legal), or the CRA's will delete because of no response. If they simply verify, that is a violation. Its a risk, but you are under time constraints. With it being a definite no now, what can it hurt? Others may have different advice. Who is the CA?
Thanks for the advice jlynn. The CA is National Recovery Agency. Makes sense to me; I guess I just couldn't put it together. Does this sound right to everyone else?
You asked for the absolute quickest way to get their tradeline removed. I am not offering advice--just personal experience on this one. File a suit in small claims court against the CA. List your cause of action as "willful violation of FDCPA." They will delete their tradeline FAST. I have found that CA's remove their tradelines before sizing up the merits of your suit. Drop suit once tradeline is removed. I have played "chicken" with National Asset Recovery and they always blink.
