I wrote to NCO requesting a validation of a debt from Cross Country Bank and gave them 30 days to respond or I would consider the debt to be invalid. They validated the debt 6 months after my request was sent. Are they bound by the 30 days or is there no limit on the time for validation. Thanks
There is no limit to how long they have to validate, however if you requested validation within 30 days of their original contact (when they were required to notify you of your right to dispute), they are required to cease collection until they validate. You can argue that if they do not validate, yet continue to report a collection tradeline on your report, and to verify the tradeline in response to your disputes with a CRA, they are collecting, regardless of what other action they take. Was their validation sufficiently complete enough to determine the correctness of the alleged debt?
