Time to Sue? Anyone Have Any Tips?

    I recently received a collection notice from a collection agency called Financial Corporation of American. I sent a validation letter, which they signed for on July 14th. On July 19th, I received a Credit Manager alert saying that they had placed a collection on my report. This seems like a violation, right? Isn't doing that a collection activity? To make matters worse, they still haven't validated. So yesterday, I mailed a letter demanding that they remove the collection from my report, and I gave them five days. Today I received a notice demanding payment. This is another violation, right? Can I sue? For how much? Under what statute/section? If anyone knows, are there remedies that I can sue for under Texas Law (the collection agency is in Texas, as am I). Oh yeah, and coincidentally, I had complained to the hospital about them placing this bill with a collection agency, (actually, I threatened to sue for HIPAA violations) and they notified me yesterday that they were dropping the matter and recalling it from the collector.

    This one should be resolved.

    Make sure the hospital copies you on the retraction. Or at least make sure the CA notifies you in writing that they are pulling the TL's.
