One of my creditors has violated the FDCPA by contacting me at work, on my cell phone, and calling after 9:00 p.m. I reported them to the BBB. In Feb 2008, the company responded to the BBB in writing telling them that they would not contact me on my cell or at work anymore. However they continued to call my cell phone over 30 times after sending that letter to the BBB. I continued to keep a record of each phone call and submitted it to the BBB online. After all these months of trying to get the BBB to intervene, they are now offfering me Binding Abriitration. I have 20 days to decide if I want to do it. Does anyone know anything about this process. What type of proof do I need that the company did something wrong? What are the chances of this going in my favor. Is it worth my time and the $75 I have to pay the BBB.?
No it's stacked againest you.call your cell phone company and get your phone records.Take them and file a lawsuit in federal court.every time they called is a $1000 fine that goes to use.You can then settle out of court for complete deletion of neg.info and use the fine to pay them off
Why are you dealing with the BBB instead of your state attorney general or the FTC? The BBB has no way to enforce laws, they can make agreements but they aren't any sort of government agency.
I could really use some help with this. How do I go about filing a lawsuit. I have read a thread about that in the past, perhaps if you know where I can get some step-by-step information on how to do this, I could go from there. I really would appreciate any help you can offer.
