To Dipspute or Not to Dispute

    Hello all,

    For those reading this, thank you and bare with me through this. I had (1) charge-off in the amount of 20K+ with Citibank. The last date of use was 8/2000.

    The Citibk entry is off of all 3 credit reports, but I have (2) different NCO entries on my EQ and I have (1) on my EX, and (1) on my TU. That is all I have my scores are from 655-665.

    The question I have is...should I dispute as NOT MINE,,,then wait for the results and then send out Validation letters?

    I live in TX and I know the SOL is 4 years. If I dispute as NOT MINE will I awake a sleeping giant.

    Please if you can be of assistance or can help that would be great. And if you do respond,,please,,please be kinda thorough as I am new trying to do this on my own. If you need more if I can reply and add any other pertaining info.

    If date of last use is indeed 08/2000 and the SOL in your state is 4 years, then it should fall off your reports by the end of this August, no? Or am I wrong? Anyone?

    The SOL for a lawsuit (4 years) has nothing to do with the SOL for reporting on a credit report (7 years).


    20K is an awful lot of money...how did you get Citi off? Where are you getting the 8/2000 date?

    Aug 2004 is the date after which they can't legally collect.
    Aug 2007 is when it would fall off the reports.

    Both of these hinge upon the accuracy of the 08/2000 DATE.

    The Sol and the reporting period have nothing to do with each other.

    To fix this discrepancy the reporting period should be revised to read 7 years or the expiration of the SOL which ever occurs first.

    ---if the SOl is 4 years, isnt this the last date the CA has to file for a judgement against the consumer? The CA can technically attempt to collect forever (letters/phone calls) unless the individual C & D them. The SOL does not make a legitimate debt go away...it just precludes the CA from obtaining a judicial order to pay...aka judgement...

    An expired SOL is an affirmative defense. What that means is the debtor must go in and raise it during court. If they file a lawsuit after SOL, and you do not appear, they can get a judgment against you legitimately.
