Towing fee goes after you

    5 yrs ago I gave the car away to someone, and he did not transfer the car over under his name, a few months later, the car got towed, now I just did my credit report, and I saw that the towing company reported to the credit agency and the amount of 1,800 that I have to pay. Btw I did send the Notice of release liability to DMV, which they got it, and I live in California, if anyone had been in this situations plz let me know what do I have to do to clear this matter. Thanks in advance.

    I was in this same situation. I confirmed with DMV that the car had been released from my name before it was towed, and they told me I was not responsible and I should just notify the towing company. I sent a letter to the towing outfit that the vehicle had been sold, and that DMV records showed that I was no longer responsible, and sent it CRRR. I haven't heard anything since.

    This is a good way to get into all kinds of problems like
    Paying for someone elses accidents traffic violations mandatory insurance violations etc.

    Always make sure the title has been transferred before turning over possession of the car.

    You may not be able to get title transferred before turning over the car. It depends on the state. But since she filed a release of liability and the state acknowledges it, she's off the hook for things like mandatory insurance compliance, etc.

    Any number of administrative things (at least here in CA)...unpaid parking tickets, unpaid registration, fix it tickets, SMOG check not done, etc. Basically, they don't have the power to stop you from selling the darn thing, but they realize that at various points in the vehicle's life cycle you will HAVE to deal with them. At this point, they'll go no further until said admin details are resolved.

    Just think about it. Did you ever trade in a car? They don't always retitile it. You're certainly not going to be able to go with the dealer to the MVA. You sign the title, you turn in your tags, you're done.

    Ever donate a car to charity? They sell it. Were you there to go to the MVA with the new owner? No. You signed the title, turned in your tags, you're done.

    You sell the car. Buyer is responsible for inspection. It doesn't pass. Or you're not taking off to go with him to make sure it does. Do you want your insurance responsible for it? No, you sign the title, turn it your tags, you're done.

    Is the car still legally TITLED (registered) to you? YES. Are you responsible for insurance, etc. NO. I think that's what they're saying. They were released from liability by virtue of turning in the tags, forms, whatever the particular state requires. No legal responsibility but still the registered owner.

    Most of the time when you donate to charity, you sign the title, leave it in the car, and take the tags. They come and pick it up. You don't even necessarily meet anyone.

    I don't think I've EVER made sure the title was transferred before surrendering possession. If I have my tags and signed whatever needs to be signed, then frankly, I don't give a damn.

    You could sue the towing co for the 1800 bucks.
