Hello all, I was wondering if someone could give advice on this situation. I recently paid off 2 accounts in May 2002. Both accts always showed paid , never late for over 24 months on TU. Within the last 2 weeks theh acct. status has been changed to "unrated" for both. My score went down 12 points as a result. I called TU they stated that both accts reported this "unrated" recently and I should call the OCs. I called Countrywide and HFC and both say they have not updated the credit bureaus since June 1st and they both have me rated paid never late. Both told me to call TU back! I called TU back and disputed both. If the dispute comes back and nothing is changed what can I do to pursue this further and make them change it? Should I get a letter from Countrywide and HFC showing my perfect pay history? Thanks! I hate TU! I have a copy of my TU report from 8/08/2002 showing both accts being rated as "paid or paying as agreed"
You just lost 2 years of hard work... going from perfect pay to unrated is a very big difference Do this: 1. Write both OCs and tell them what's happened. Ask that they a: verify to you whether or not TU contacted them during the dispute and if so, how b: Send you a letter confirming the status of your account and how it is being reported by them to TU c: Contact TU directly and get the trade line changed from unrated to perfect pay again You may want to edit your 2 TU reports to show the before and after TU reports for each OC so they may see exactly the differences... 2. Write TU... if there's not already another dispute going for both trade lines... don't get irate yet... but do a normal letter asking for a: disputes on both accounts that they just unrated to go back to perfect pay b: procedural descriptions for the dispute they just finished c: procedural descriptions for the disputes you're now requesting when the reinvestigation is done If there's already a TU dispute going... I'd still write but state that since they're in process of being reinvestigated... you're sending a letter just confirming what's being investigated and that you want the proc desc's from the previous disputes and for these now going when they're done. Send all 3 letters certified return receipt requested... then see what happens. If the new investigation comes back unrated... I'd start suing... Your OCs will blame TU and TU will likely tell you unrated doesn't hurt you (of course it does) and you'll set yourself up for quick corrections and perhaps a lawsuit if the OCs come back to you and say they were never contacted. Up to you how to proceed after that... corrections or corrections with money for your efforts. Remember: it shouldn't take this much of your time and energy sorting out TUs errors... and if you have any damages from these errors you can be compensated for them... plus your expenses, plus statutory damages... plus punitives if the judge will give them. I now truly believe these guys will never change until they get so innundated with lawsuits that the average cost per screwup becomes so much that they then take their training and their jobs seriously... until then... this is the quality of work you'll get from the bureaus
Tommy, Is Equifax and Experian reporting correctly? If so, you'd think the OC is telling you the truth and it is atotal TU foulup.
Keepmine, EX and EQ are still reporting these two accounts correctly. I explained this to TU and they didn't seem to care and continued to repeat their vebiage: "The OC provides us with this information and we just display it". I basically told her she was full of sh$#t. I want to get my ducks in order and punish them this time. Its creating a lot of extra work on my part and undue stress. We all know if your score drops CC companies will increase your APR or lower your limit which equates to even more damage. I have legal services that are part of my benefits at work. I think I'll use them. Thanks
up to you I'm guessing you don't have any letters to them cert rr yet... so I'd just send a normal letter without a lot of threats (keep low for now) and see what happens... you need a paper trail that proves you sent the disputes and they received them... in the interim... if you want another set of FCRA violations... have your local bank pull your report (apply for a line of credit or something) with a nice loan officer... and low and behold, I'd bet my first born that there's no notation whatsoever of any disputes being in process (this is if they accepted the disputes already over the phone)... If there's not a dispute going now... let your letter get there with the new round then go to a bank and have them pull your reports... Tu's system is so antiquated that it can't even mark items "in dispute" as being in dispute... auto fcra violation per dispute always... Can we all say "thank you TU"... you can always blast in the fcra in a demand letter later but I'd keep it simple for now... are your disputes running again now or do you need to resubmit them for these 2 trade lines?
