I wrote a letter to Trans Union asking them to remove a collection account. Here's the deal: The original creditor released me from the debt and they gave me a signed letter stating that fact. I then sent a copy of the letter to TU along with my letter and their response was "We have reasonably determined that the dispute submitted on your behalf is frivolous or irrelevant. For these reasons, we will not take action on the dispute." I am so mad because I submitted proof that the debt is not mine and they rejected it. My question is how can I file a small claims lawsuit against them? I am in Georgia and their office is up north. Any help would be greatly appreciated.
Hi Payoff, What's the exact wording of the critical portion of this letter? How's it worded? If it says somethin like "we release you from your previous debt", they may be using that as proof a debt did exist. Or does it say "NO DEBT"?
Also, with TransUnion, you need to make sure that everything matches how the tradeline is reporting by the data furnisher. I had a similar problem when a bank sold the account to a CA, the CA created a new account number for the account, and the information on the letter didn't match 100% so they needed to verify with the CA, and the CA refused to remove... Finally the person at the bank called the person at the CA and told her that "IF the consumer sues us, we will settle, and then we will sue you for everything that we had to settle for." After the bank bought back the account it was gone. I still had to dispute it through TransUnion again, but finally it went off...
Unfortunately, you can't be released from a debt and, at the same time, claim that it's not yours. That's probably why TU is deeming your dispute frivolous. Did the creditor indicate in their letter that the debt is not yours?
