I faxed a letter from my attorney to TU back on 4/12 informing them that the furnisher is providing inaccurate, unverifable information with instructions to delete this account . as it has been disputed and reinvestigated 3x now. so TU send me a frivolous letter today and ignores the request to delete and sends they need documentation from the furnisher which I know will not happen hello that is why I am faxing you a letter from my attorney. so question how long should I wait or do I need to wait to pursue a lawsuit against TU for the violation? only if you informed them WHY it is inaccurate would you have a valid suit Here is an example from Spence v TRW " When the $461 hospital debt was reported to TRW in June of 1990, TRW did not know that the debt had been placed for collection five years earlier. When TRW released its residential mortgage credit report on September 17, 1992, the placement of the debt for collection antedated the report by more than seven years. Again, however, TRW was unaware of this fact. If Mr. Spence had "directly conveyed" to TRW the pertinent information on when the hospital debt had been placed for collection (see 15 U.S.C. §1681i(a)), TRW would presumably have deleted the item as obsolete pursuant to §1681c(a)(4). Mr. Spence failed to do so, however, [1] and on the facts presented we are satisfied that this failure was fatal to the claim asserted in Count V of the complaint. "
I informed TU that the acct did not belong to me, during the 3 investigations, and stated that I contacted the furnisher directly and they have no proof . I sent the letter from my attorney that states the furnisher has no written contract with me, I am not indebted to them in any amount, and they must remove this acct from my CR. In my letter I stated that TU is reporting inaccurate, unverifable info i as stated above. is that enough to substantitate my claim to pursue a lawsuit or do I need to wait to see if they will remove it . after this requests the sent me a frivolous dispute letter sounds like they have me on ignore. so my question is this sufficent for suit?
My opinion yes.. Might want to talk to your attorney though since he wrote the letter....He may have to come to court even if just as a witness.
I think it will be going to fed court how many of those are located in CA are they in main counties or just one for the whole state?
There are a few....check out findlaw.com or search for CA district courts I would add that small claims is faster, cheaper, and you can get just as much
small claims here goes up to 5k I am suing the furnsiher also, so I think I would want to ask for more then that considering all the violations. and major problems over the past 5 months
