I submitted a police report, notarized ID theft affidavit, and my drivers license to Trans Union. They received the documents on March 7. My understanding, under FCRA (amended after FACT), that they have 4 business days to permanently remove the ID theft accounts. I checked my report 3/16, and they just removed 2 of 7 accounts, and placed an "extended fraud alert" on my file. So I call, and the girl says they have 30 days to investigate. I challenge her on it and she says I have to speak to a supervisor who will call me back in 24 hours. CLEARLY - I tell her - the amended FCRA allows only 4 business days (actually funny enough I had called them a week earlier and they confirmed this verbally the first time around). This is the FCRA passage: "...§ 605B. Block of information resulting from identity theft [15 U.S.C. §1681c-2] (a) Block. Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of-- (1) appropriate proof of the identity of the consumer; (2) a copy of an identity theft report; (3) the identification of such information by the consumer; and (4) a statement by the consumer " So WTF with them saying I have to wait 30 days? Then I asked her for the legal dept contact info and she comes back on the line (almost laughing it sounded like) and said they don't have a legal department. What should I do now????
