I had a business failure in early 2004 which resulted in numerous charge offs, delinquencies, and a foreclosure listing on my report. My business fortunes have changed for the better, and with my increased income, I made the mistake of settling all the delinquent accounts with the OC or the CA without obtaining a deletion concession. I settled about 80k in unsecured debt. I still have two active mortgages that are current, but show lates. I have reestablished new credit (target guest card, chevron gas card, bank of America secured card) and have been current for 8 months on all accounts. I have been disputing the accounts (which all contain erroneous information ) as not mine, using on line disputes. I am on my third round of disputes. Equifax and Experian are still reinvestigating, however, transunion has decided that since the OC verified once, my subsequent disputes are "Frivolous" I have received responses from TU, 90 days apart, labeling my disputes as frivolous as they have previously verified the accounts. I need guidance as to the next step. Do i demand that the OC verify? Do i request TU's procedures in the original verification? Do i redisupte saying the original investigation was inadequate? Do i acknowledge the account as mine but say never late? Future 800 club member for Experian and Equifax, 500 club member for TU.
Do a procedure request to transunion. They will reply with a generic form letter. You will write back and say that is not sufficient. They will reply with another generic procedure form letter but in this one, they will insinuate you are using a credit repair company and ask you to disclose them to them. Disregard and keep asking for the EXACT procedure they used to verify the debt. Now in my experience at this point they always initiate another dispute just keep spamming them with letters.
CSX, Try Jen's idea first. Than ... ... if you can come up with different grounds for your next dispute that should do the trick.
I am having the same problem with trans union and also the prev. verified problem. I would like to know where I can find an example of a procedure request letter.
What i basically say is "Please explain the procedure used to verify this debt and include contact name, etc". I don't recall the section of the FCRA that outlines your rights to know the procedure. i know there is a letter around - you may need to search because i don't know if it is in the sample forum.
