I disputed several items with TU online. It was submitted on October 21st. I received a letter today stating that they received my dispute requests, but also received "additional information" on October 22nd, and that entitled them to an extra 15 days to complete their investigation. They state in the letter they now have until 12/3/2004 to complete their investigation. I have NEVER had this happen to me yet. How can they go outside the 30 day window? Do I have any course of action to take here or do I pretty much have to adhere to their actions. TIA
Did you contact them or send them any "additional information" ? If so, then yes they do have 15 more days. If you did not provide them with information you might have a case!
I did not provide them with any additional information that I am aware of. I pulled my TU report, disputed the items online (don't know if that makes a difference) and I thought everything was fine. When I received that letter I was very upset, as it basically lets them drag their feet on this. I do not belive they should be able to skirt the consumer credit laws in this manner, but I don't know what recourse I should take. I would like to call and question this action, but I don't want to have my filed "blacklisted" or cause myself problems for future disputes.
I would send them a copy of the letter they sent you, along with your own letter stating what you wrote above - that you disputed on line and nothing else. Tell them that as far as you are concerned unless they can prove that you contacted them with additional information, then they have only the original 30 days to investigate your dispute, and if not completed within that time, you will file a complaint with the FTC for violations of the FCRA! Wait until 25 or 26 days of the original 30 has passed, that way when they receive your letter it will already be past the 30 day limit, and you can demand IMMEDIATE deletion if they did not complete their investigation send your letter CMRRR!
