I have been MIA for awhile, we had a car accident last week and I am getting over a nice case of whiplash...ugggh! But all is well except for 250 in car parts and a resolution to never drive in rain!! So I have had a little time to work on my credit and it's slowly getting better. I've gotton a split file issue with TU cleared up, a few more accounts reporting correctly and still wrestling with a few. I was wondering if I might get an opinion on some plans I have? I have a pre BK Verizon CO that is reporting on all 3 CRA's as a chargeoff and not IIB. I have disputed with the CRA's result verified. I have sent 3 letters over the past 5 monthes with no reponse whatsover. Got green cards to prove it. Should I call them? The other is the evil evil TXU utility collection that I had thought was paid until I checked my reports initially and saw a balance listed. I had moved, got a final bill, paid small payments till the full amount was paid and heard nothing further. I disputed with the CRA's: result was verified. I sent 2 letters before they ever sent me anything back. What they sent me was a ledger of what my bills & payments were. I sent a letter recently asking: Why acct went to collection? When did acct go to charge off status? Was there a written notice sent stating the acct would be reported to the CRA's as a negative acct? What address was the last bill in this amount sent to? Thier response was to send me yet another copy of the bills and payments made. /groan Good news is this is now only present on Exp. Should I continue to haggle with TXU? Or should I redispute with Exp? I would appreciate any insight. These two accts are driving me crazy! Thanks! Tegleg
Time for court action, Teg. You've completed all the "prudent" actions, and given all parties sufficient time to respond and react correctly. Now, it is time to take your cases to court. The best first action is to draw out timelines of events and actions, and organize any and all documentation you have. Be able to condense your case to simple statements. Next, find a decent attorney. Contact your state's Bar Assocition Referral, they will give you several options for attorneys in your area. The fee is nominal ($25 +/-), and that usually covers the initial consultation. Study the legal cases and proceedings here on the forum, and start researching small claims and higher courts in your area for rules of procedure and so forth. Time to got to war!
Ohhh boyyyy..... I figured that was coming. Yikes. Ok, I think I am going to make a last effort to dispute TXU with Exp in hopes of removing it since it is only on Exp now. Verizon is another story it is on all 3 and won't budge. I am going to check and calculate when it is to fall off my reports. If that date is within the next year it may be prudent to wait and let it fall. Since I am not activly seeking credit at this time. If it will be there awhile I think I will need to take action. Would a intent to sue letter be prudent for Verizon at this point? I was thinking it may wake them up to realize I am serious. Is that a good plan? One more letter to Verizon will not hurt anything, it will only strengthen your case (if you go to court). But, do not expect anything in results. The only other suggestion is to get on the phone, and keep moving "up the ladder" until you reach a person with the power to make changes, and work your case with them. Personally, this has always worked the best for me. I was succesful with Verizon Wireless doing this, but my case was a bit different. Mine was an ex-employer who put my name on the corporate cell phone in addition to thiers. Verizon kept saying it was my responsibility (as well), and wouldn't budge on the TL. I finally got to a manager, and the manager agreed to remove since it wasn't my account. So, one more try with a letter, and perhaps follow up with phone calls can't hurt. But, if you threaten with an ITS, be sure you're ready to carry it through. Good Luck Teg,
