tricky question

    Ok, try this one...anyone..... IF you declare bankruptcy and wipe out a debt, once this debt is discharged could you "technically" use the "not mine" dispute? It just seems like this may be a loophole(small but still there) If this debt is wiped out in bankruptcy it would no longer be mine, true? It may have been mine at one point in time but the CA didn't update the debt as "included in bankruptcy" and I disputed it as "not mine" how did it come back as verified by equifax? Do I have a leg to stand on or should I try another tactic? This is also the same creditor that pulled an inquiry after the bankruptcy so I am going to be letting them know they pulled a credit report without permissable cause.

    Technically, they are saying the money you owe is erased, but the acct itself still existed. Legally, it must show 0 balance, included in bk.

    Therein lies the problem. They are showing it as an owed account "unable to locate customer" with a balance on $5899 but in order to dispute it I have to send in my discharge papers to get it "included in bankruptcy" thereby effectively hanging myself. I can not figure out another way to approach this.

    this was a good question, and i'd like some direction as well...my ch7 was discharged in june...there are two accts that have come bk as verified (twice), but they were included in bk...i'm in the same situation b/c i do nt want to send in cpz of my bk paperwk...

    What about sending a copy of the BK cover sheet along with the Schedule of Creditors, except blank out all other creditors except for the one(s) in question.

    Well ... I think you'd prefer to have it removed right ?

    Just keep disputing as not yours. Eventually one of 2 things will happen. Either they correct it and include in bk, OR they remove it.

    If you send BK info. only 1 thing can happen, it'll get included in bk.

    Keep trying, maybe you'll get lucky. But either way keep at it until something changes.

    No no no no no.

    Never, ever send them anything regarding any negative. They keep everything you send them, and a few years from now, if you try to dispute this bk, they will have the proof they need without doing anything - because you gave it to them.

    Another question to raise with them. How come, in this case, they are willing to accept information from a consumer, but when a consumer has proof that a negative entry should be removed, they are unwilling to accept that proof from the consumer?

    How about disputing it with OC? After all, they already know for sure it was included in BK.
