trying to get accurate credit repo

    This is reguarding an account opened in 5/29/01 that he did not know about until 2/02
    I have been trying since 3/02 to get my husband's credit report corrected. I think TU is finally correct. Experian and CSC finally removed the MBNA account but then put a collection account for the old MBNA account that never belonged to him. The collecter called 9/28/03 and I told him that the account was not my husband"s and he had requested validation from MBNA, a lawyer, another collection agency and no one had sent anything with his signature. I also told him that I was requesting validation from him and that he didn't have PP to pull his credit report. My husband sent the first validation letter 9/29/03.
    We live in Texas so they had only 30 days to validated and should not reported until validated. 9/29/03 they pulled his report and put their tradeline on it. He sent another letter on 11/3/03 requesting validation. Finally 2/04/04 he received 3 statements, I guess the last three that were sent to the Utah address and something with a bar code that said sold 1/1/2000, my husband's name, without middle intial, and seller account # and no buyer. He sent another complete validation letter and request to deleit tradeline 2/13/04. Then on 3/03/04 he received the 3rd collection letter, this one said it would be forwarded to an attorney for legal action. This account has been updated every month on all 3 credit reports and experian verified 1/04 and 4/04. If he decides to sue them what are the violations and when would it have to be filed? Are should I send another letter ITS and ask for payment for the violations? Please help with this.
    All of the credit bureaus have his fraud alert, fraud affidavit and report and still have done nothing, just keeps sending his report to anyone who ask. He has also Opout on all reports.

    Someone, please help me on this. I am about at the end of my rope. I do not understand why a person has to have a report from the credit bureaus, that is not correct. We have always paid ours bills on time and this is something we had no control of.

    Did MBNA accept the aff. of fraud, and acknowledge that the account was fraudulent?

    I don't know if they excepted it or not. He went to our bank and they helped him write it and notarized
    the letter. He had requested an affidavit from MBNA when they called but they never sent anything. They may have sent to UTAH even though he told them to send it here. What makes us so mad is this is something that could have been stopped if we had been contacted before they mailed the card. All MBNA had to do is call or write the address and phone # on his credit report and ask if he opened the account. That was the only address we have had since 1973. There is no way we will pay a bill for $18,000.00 that we did not spend. If someone would sent something with signature to prove that he made the application and the charges, then that would be a different story. I feel the credit bureau should have something in place that would not let anybody pull a report with wrong address, phone# and wrong birthdate.

    You signed an affidavit of fraud? Did you also file a police report for identity theft?

    FACTA amended FCRA to require both CRAs and data furnishers (the OC or CA) to cooperate in removal of erroneous information on credit reports due to identity theft.
