How do I dispute items that have been sent to a collection agency and appear on my reports. All of the collection agencies involved did not contact me. Is it too late to request validation? What can I do? I'm trying to get a mortgage loan.
There are many ways to premise a dispute. How and which ones would depend on what they're reporting on your credit reports. Without that information it is impossible to ascertain what may and may not work. In theory, you can always request validation. However, if thirty days have past since the initial communication was sent to you, they do not have to validate and can lawfully continue collection activity. However, you would have an argument to present here if indeed they never sent you anything and the first time you had occasion to notice the collection was upon reviewing your credit reports. Assuming this is true, send them a communication wherein you state that they have five days to send back to you what the debt is for and to who it is owed. This may lead to a deletion and it is grounded in the FDCPA.
