I apologize if the answers I need are in this forum but I have done so much reading and there seem to be so many variations of answers I thought I would just come here and ask. I received a copy of my credit report and I have 3 credit card items with 3 different collection agencies. Items totaling 22,000. I lost my house and business in 2005 and have not been in a position to talk to or offer any kind of settlement in past 5 years. I have not received any letters nor notification of debts due. Nor have I received phone calls. Probably due to the fact of moving around so much. I am now in a position to make an offer to settle. The main reason I ask is because I will be opening a bank account again soon depositing close to the full amount that I owe. Will the CA's be able to see this and take action ? Just wondering what my best recourse is
You may want to first look into the SOL for your state to see if the CAs could still obtain a judgment against you. They won't be able to actually "see" the amount of money in your account, but I do believe there are ways for them to find out where you bank. If they can still sue you and obtain a judgment, then they can most certainly come after your assets.
