TU again!

    This weekend hubby got his "updated" report from TU after disputing a closed GMAC account for the 4th time. There are numerous previous lates listed which are correct, but it is also listing status as of 8/01 (payoff date) as 60 days late...even though the last late was 3/00. So I called GMAC, spoke to a supervisor, and she sent a letter to TU and sent me a copy as well, showing that yes there were lates, but it was brought to current prior to payoff. TU doesn't care, sends us the updated report with no changes! I looked at the date of report and date of letter and they are close, so I figure "hmmm, maybe they got the letter after they sent the report"

    So today I call TU, and say that I want to check the status of this dispute because it came back the same...the lady says "yes, GMAC responded 11/16 and told us that all info is correct"

    Then I said "really? That is strange, because I called GMAC and spoke to a supervisor named XX who sent you a letter stating that the current status is incorrect, and by the way, she sent me a copy too!" The TU rep, pauses and then says "really? Hmmm, we don't have a copy of that letter, can you mail it to us?" I said I will FAX it to you and I want it fixed right away. She gives me the fax number and says to call back in a week.

    So....what is TU's problem? I just caught them in a lie I would say, what do I do if they still don't fix this? I am really getting fed up with them!

    no kidding...surprisingly(not) TU is his lowest score

    If they still don't fix it have them served. That is soooo ignorant of them!! They just don't give a rat's a$$ do they?

    This is happening to me also

    TU did the same thing to me. My auto loan was paid off in July of this year. I check my report the next month and they have me listed as 60 days late as of the pay off. How can I be 60 days late if I paid it of and you have me current for June.

    Ford credit sent me a copy of an updated manual report clearing up all issues. I am waiting until the first week of December to check my reports to see if they are current.

    If not, lawsuit baby against Equifax and Trans Union. I have created a clear trail of my attempt to clear their error.

    So what kind of letter should I send them to tell them that they better fix it or I will sue? Does anyone have any ideas?

    I don't have a letter template for you, but a couple of ideas knockin around the noggin'. It seems to me like you could do a quick search of the FCRA and pull out the pertinent sections about their obligation to make a good faith effort to a) put only accurate information in your CR in the first place, and b) verify any information which is called into question by the consumer. They clearly fell down on this by "verifying" without actually talking to anybody or requesting any information from the creditor. I'm not a lawyer, but it smells to me like a cut and dried Willful Disregard for your rights under the FCRA. While you're at it, you, or better yet, a creative attorney, could probably come up with some violation of your rights under the Federal Civil Rights statutes (they are very broad), on the premise that you have a right to not be deliberately slandered by a CRA. Probably a long shot, but it might well be expensive to defend against, and would make the Willful Violation of your rights under the FCRA charges more likely to result in a cash settlement in addition to correcting the record.

    This is all theory, as I have no experience directly related to this, but thought it might be worth chewing on.
