TU having trouble with the math

    SO...

    I sent a letter (CRRR stamped as recieved June 25) to TU to dispute a VERY obvious mistake. They sent a response about a week ago saying they recieved it June 26th (lie, but I figured I'll give them 1 day), and would investigate in 30 days, blah, blah...

    Then I sent a dispute to all 3 CRA's on a less obvious but real mistake on two DIFFERENT accounts. TU recieved their copy June 2nd (as certified from green card).

    So, yesterday I recieved a long reponse from TU. They claim that:
    A) They received the first letter June 26th.
    B) The "ADDITIONAL INFORMATION" was received July 5.

    The letter goes on to state that the additional info allows them 15 additional days, giving them until Aug 8th to investigate. This doesn't add up to 45 days from June 26th, but that's not the main issue I have with this.

    I did not provide any additional info. The second letter was a seperate dispute with no reference to the first. Is this a violation, or am I stuck with the dates they are giving me, since I did send another letter? What about the misrepresentation of receipt dates?

    At the end of the last response, they also infer that I was/am using a credit repair company, and offer to report them "to the appropriate authorities" for me "If you have reason to believe that the fee changed by a credit repair company was too high, and/or its services were misrepresented..."

    (B) Extension of period to reinvestigate. Except as provided in subparagraph (C), the 30-day period described in subparagraph (A) may be extended for not more than 15 additional days if the consumer reporting agency receives information from the consumer during that 30-day period that is relevant to the reinvestigation.


    The key word is relevant. If the second dispute you sent in had absolutely nothing to do with the initial dispute, then they're wrong. They have 30 days from the date stamped on the green card. Which would be July 25th for your first dispute.

    You can either call them and advise them as such, or, fax them a nice little note, attach the above section (which is 611 from the FCRA, BTW) and tell them they have until the 25th. Better yet, wait until the 24th or even the morning of the 25th if you're going to fax, you don't want to give them any time to figure out how to break the law and just "verify" the account automatically.
