My husband and I both disputed online with TU. I disputed tax liens, they are gone with no mention. My husband disputed 4 items that were not investigated at all. The only items listed as investigated are the tax liens he did not dispute! They were changed to paid, and they are, but the paperwork is not filed with the courts, so obviously they did not really check. Would it maybe cause them to reinsert the tax liens on my cr if he calls them, explains how they disputed the wrong items, and adds that they removed the liens from his wife's report? How would you expert handle this? Does ths put us in a position of power, or is this a minor boo-boo? Thanks
Wow!! you lucked out!! No don't mention it. Just dispute his again, and let sleeping dogs lie. breeze
Breeze, So you don't think he should call them and complain because they did not investigate the items he asked them to investigate?
I have the exact same situations....tax liens that are paid but not cleared with the courts yet. Just for the halibut I disputed the liens with TU. They were deleted, but reinserted within a couple of weeks. I think we need to push the state to clear up their end to show paid.
Nursie, I agree. However, I just found out this week the total of the filing fees. I don't have enough to pay them yet. I sent the release of lien letters first, but they were all returned with a request for $$. The strange thing is that my husband did not dispute them!!!
Maybe you don't have to do that where you live. It is a real rip off! For one lien, the fee is over $70.00! The others are more reasonable, about $26. I live in Ohio.
Breeze, I was hoping that maybe because they did not even do the investigation he requested, they might just deleted them. Aren't they required to investigate the items he lists? I thought maybe this would work in my favor!! Oh, well. I was able to have a big list of inquiries deleted from my report, they are also on his. I guess your answer would be the same, don't mention that they were deleted from my report to try to get them deleted from his.
CONGRATS!!! YOU JUST WON! Yes, it can help you!!!!! GIGGLE RIGHT NOW. Call and tell them they failed to investigate items on your dispute request. They'll try to take a NEW investigation. That's a big FCRA violation. Say NO. you want the tradelines updated (or deleted if they suck) right now. They've had their 30 days. They'll tell you no. Get a supervisor. Tell them you're ready to file a lawsuit tomorrow if they don't delete/ correct RIGHT NOW on the phone. Period. They've had their 30 days, and you WON't pay. They should do it over the phone. I've heard of others who've had similar circumstances and they deleted on the phone. If they don't, GO TO SMALL CLAIMS COURT!!! Your case is cut and dry. You don't have to ever say, I put this and you did that... just say, I have these 4 items that you didn't address at all. You didn't receive a letter stating they didn't understand the dispute, they didn't say they couldn't find the tradeline... they just ignored you. Now make them pay attention! If you have to, Talk to them on monday and if they don't jump. file. 4 items off for 100 would be a bargain! but I think they'll do it over the phone. If you have more than those 4 negatives, then I'd just file. They'll clean your report in exchange for you dropping the lawsuit. You have them dead. period. You don't have to do another thing. Congrats!!!! When you start realizing their crud will help you... you get excited that they really suck at their jobs. It makes our lives easier.
Re: CONGRATS!!! YOU JUST WON! Marie, Did you read the whole thread? I agree, under normal conditions I would use it against them. But their mistake was in her favor. I would be afraid they would reinsert the tax liens when challenged. breeze
Re: CONGRATS!!! YOU JUST WON! The tax liens were disputed and deleted from my report. My husband did not ask to have the tax liens investigated, but they investigated them. They did not investigate the items he requested to have investigated. I think I will consider the lawsuit if it will clean up his credit report, based on the fact that they did not investigate the items he requested. I won't mention the tax liens at all.Too bad it isn't Equifax!! Where do I file? Is it small claims court?
Re: CONGRATS!!! YOU JUST WON! Marie, Oops, I reread your post, You already said it was small claims court. Sorry. The muchkins are waking up now and I am distracted. Thanks for the help, Marie and Breeze!!!!
Re: CONGRATS!!! YOU JUST WON! Breeze, I understand what you're saying.. but think about it from their perspective. They did an investigation on the tax liens... right? (ok they didn't bother but they'll think they did their jobs correctly)... so why would they even touch that issue? they won't. If they really did their jobs correctly then they took the lien off for a reason. The point: DON't say it stayed on report x, but left on report Y. unless you're doing it in a lawsuit. Otherwise it might lead to reinsertion. BUT, if it was just put in evidence as their inability to get a consistently correct investigation, it's great evidence! Regarding the 4 items they missed: She just has to say that they neglected to even investigate 4 items: being x, x, x, x. When she calls they'll either try to reinvestigate or delete all now. If those are the only negs then that's what I'd do first. Call. If there are other negs, then I'd use a lawsuit to clean the report completely.
TU Deletions I just got my TU results back from Junum's last round and had three positives deleted and one positive changed (not sure what the change was). I also got about 4 negative deletions that were not listed in the TU update section but were now gone. Anyway I have been sending Junum my reports with white out for ALL positive items so there is NO WAY Junum could have disputed these items...TU simply deleted them on their own. I am POSITIVE TU is doing this on their own. -Dave
