I've opted out of credit solicitations about a year ago. Chose the 2-year opt-out.

EXP & EFX complied. So did TU - or so I thought.

I kept getting Fleet pre-approvals. No soft INQ's appeared at the time on any of my reports, so I assumed they bought a mailing list, without my credit info. I was wrong. CHECK THIS!

My TU report, pulled a couple of days ago, promo INQ section:

    Date Subscriber Name
    07/2001 BANKFIRST
    06/2001 BANKFIRST

My TU report, pulled today, promo INQ section:

    Date Subscriber Name
    01/2002 FLEET CC
    12/2001 FLEET CC
    11/2001 FLEET CC
    10/2001 FLEET CC
    07/2001 BANKFIRST
    06/2001 BANKFIRST

Yes, that's right. TU has kept selling my credit info MONTHS after I've opted out (a request processed by the other 2 CRAs with no problem). TU also waited 5-8 months till it chose to display them on my report.

To me, that's fraud with a capital F.

P.S. - As you can imagine, I chose not to utilize the above credit solicitations, sent by a bank that is not exactly my favorite ;)

Can you send the $1000 letter based on PRM inquiries? That would be quite interesting. I think I'm going to have to sue TU for refusing to investigate hard inquiries anyway. So, do you think there is no differentiation between soft and hard? I also have the opt-out. Hmmm....

I am having the same issues!!! I have written to Equifax - I have BankOne on my Equifax for March of 2002. I opted out early last fall.

Did you keep the letter they send you to sign? I didn't make a copy. Doh.

Oh wait, I have all those copies of my reports that state clearly "file blocked for promotional inquiries."

I didn't keep a copy either. <sigh> I guess I just don't think sneaky enough. I never thought it would be an issue. BUT on my Equifax, it says right at the start of the inquiry section "File blocked for promotional purposes". Doesn't your's say this? If so, and you have an old report that says that line but doesn't have the PRM inquiry you've got them. Show your new report with the PRM that was obviously after you opted out and there's your proof.

I just noticed the same thing on my Equifax. I'm going to have to go hunting for the first blocking and the last non-blocking reports, now. Here goes my $1000 Letters!
