Thanks to all the great info here, I am well on my way to having clean reports. I have one account that has me a bit puzzled... This account has disappeared from EFX & EXP. Portfolio RC (CA) as follows: TU online & WK dated 3/4 shows DOLA as 4/96 I disputed the item as not mine. TU online & WK dated 3/20 does not show the item (yeah!) TU mail dated 3/26 (investigation results) has no TL, but says it was verified. WK dated 3/28 shows the item again with DOLA 9/97. TU online dated 4/2 shows DOLA as 9/97. I have older reports from the other CRAs showing 4/96 as DOLA (even a report from 2000). I'm pretty sure I have a couple of violations here, such as reaging & reinserting w/o notification. Am I correct and what is the recommended way to proceed?
They have 5 BUSINESS days to notify you of the reinsertion. Then you would need to allow a few more days for mail. Once that passes, I would write TU a nasty letter quoting the FCRA in regards to the reinsertion, and the fact that it was reaged. Build yourself a papertrail for a possible lawsuit. I honestly haven't had any experience with reaging, but have to constantly battle CSC with reinsertions. It is my understanding that TU folds easily under the word "lawsuit". You might want to search on illegal aging or reinsertion to see what others have done. Good luck!
The reaging complaint is valid, however, he will get nowhere with the reinsertion violation, IMO. The report showing results said verified, even though for whatever reason, it wasn't there. My suspicion is that it was verified, but due to it having a dola of 4/96, the removed it. Then it was re-reported with a new dola. I think the ca is who you want to go after.
I'm bringing this up again because there is an update. After writing the FTC, BBB & AG, and sending strong ITS, they removed the TL (I'm still gonna sue, because I had to get really high interest for car and cuz they're scum). Since then, they have pulled 2 soft inq's on each of my reports. Can you use the no PP argument for soft pulls? TU 5/22=770 EQ 6/03=616 EX 5/01=657
Re: Re: TU reage & reinsert Otto, When a CRA reages the "date reported" usually remains the same. If the CA reages, it'll have a new "date reported" date. Check and see. LKH is right. Your argument is almost surely with the CA. The CRA's really have no motivation to do the reaging. Especially if there are other derogs on the report. And YES, No PP's are good whether soft or hard.

I didn't mean to make it sound like I was going after TU for that; I was going to go after TU and EQ for reinsertion w/out notification. The no PP thing makes me very happy! I have a ton of documentation from this CA saying they would remove the TL and that they "were in full compliance with the law". As soon as I find a good atty, I'm nailing them!
