I rec'd a form letter from TU requesting my assistance with their investigation....is this acceptable? Has anyone else rec'd this? Basically I disputed a BK13 to update as discharged as well as several accts that should be reported as discharged in BK13 but are not. In return, they are asking for my assistnace in forwarding them all my BK13 papers and discharge! Do I have to do this? Are they saying that if I don't, none of the items will change? Does anyone else have any experience with this? Thanks in advance for your help! -NiceGuy
Yes And whatever you do DO NOT send them any of your BK information!! It is their job to verify it not yours and tell them that! If you want the account to be reported as included in your BK then call the creditor and tell them it is being reported incorrectly and ask them to send in an update for you.
I made that mistake a few years ago,(before I found this board.) I sent them all of my discharge papers and then they still messed it up and put active positive accounts as 'included in BK'. It took months to get it fixed. Whatever you do DO NOT SEND THEM ANYTHING!
Ok, I won't send them anything...does this mean that they won't update any of the info within the 30 days? What recourse do I have if they don't. I have contacted the creditors directly via Certified Mail to update their entries, but what about the BK 13 status? Are they refusing to update, and, if so, isn't that illegal? What can I do in such a case?
It occurs to me that this is like the cop asking you how fast you were going. You really don't want to answer that question.
Do you think they will even try...or just say that it was verified and remains unchanged? If they do that, what are my rights (next steps)?
It is really LOGICAL when I dispute an account based on the FACT that the credit limit MUST be stated...when it says N/A that is NOT a CREDIT LIMIT!!! ...AND IT COMES BACK...VERIFIED...N/A CREDIT LIMIT REMAINS!!!
George, I managed to get Equifax to report the Credit Limit on my AA Citi World card. It took several disputes and sending them copies of my original card acceptance letter and a copy of a statement. When they verified it with no change it I faxed them several letters, a week apart, each more agressive than the last telling them they were in violation of the FCRA, specifically, the clause concerning the fact that they have to use reasonable procedures to ensure "COMPLETE and accurate" reporting. I always included copies of previous correspondence to show that I had a paper trail. I told them that if I did not receive an updated report listing the credit limit that we would just have to have a judge sort it all out. After about a month of trying I received my updated report with the credit limit added. I still have to get TU and EX to include the credit limit, though. I haven't started working on those two, yet.
COMPLETE and ACCURATE are the "key" points... NO CREDIT LIMIT stated is NEITHER COMPLETE nor ACCURATE!!!
