TU suppression= EXP exclusion code?

    This sounds similar to the situation I mentioned in my first post at top.

    It seems to me like the CA I was dealing with also told EXP to delete but instead of doing so, EXP placed an exclusion code on the account. Although I can still see it, nobody else can.

    This is slightly different from your situation (because you couldn't even see it) but it sounds similar.

    Now, if EXP put the exclusion code on the tradeline, it is probably a good thing like Butch states because it will prevent the CA from ever putting a TL back on there (I just hate seeing a TL in the negative section). Howver, if, like one CSR said, the CA put the exclusion code on it (which really just wouldn't make any sense would it??), then it isn't a good thing because at a later point in time, they may unhide it.

    I don't understand why a CA would ever suppress a TL (instead of just deleting it if it was incorrect OR updating it to ACCOUNT DISPUTED and/or NO STATUS). It sounds like it is more commonly done by the CRA but as you see from my original post, even EXP don't know what is going on.

    WOW!!

    I never knew about any of this nor have I ever heard of someone requesting their entire file!

    This is pretty cool.

    Now I guess, we just need to come up with a form letter for it.

    Do you think it is as simple as saying:

    Dear Equifax,

    I am contacting you to request my entire credit file (not just my credit report).

    According to the Fair Credit Reporting Act, Section 609, you must comply with my request.

    My SSN is XXXX and my DOB is XXXX.

    Please send this file to me as soon as possible.

    Something like that??

    I can almost be sure though that one of two things will happen to me:

    Either a)

    They will reply stating that a credit report costs $$$, please respond with a check.

    Or b)

    They will just send out a regular credit report.

    Don't forget the "proof of identity" (i.e.-copy of license, SS#, address proof, etc.). I'm sure on this one they will be "to the letter of the law" also. They will probably look for every legal avoidance loophole they can find.

    I have heard of people getting these reports; they usually use them when suing, to prove that procedures were not followed during a reinvestigation, or that no actual "verification" occurred. Per others, they have waited until ALL disputes on a "file" have been kicked back, Procedural evidence requested (and not supplied), etc.

    As a note, to use this you need to have all your papertrail in order also. The one thing I am NOT sure of is, how your "file" is "marked" after that. I'm sure you get blacklisted somewhere or somehow!

    I will, I plan to do this with Exp; as they have been the worst for me. I have two more Procedurals to do, and one more BIG dispute (which I just noticed late last night I've been sooooooo....dumb with!!, a CC CO I've disputed over and over, it has the wrong account number! After six months I just noticed it on all 3 reports!!)

    But I will forward a copy of the letter after submitting.

    How will you dispute the TL with the wrong account number?

    Account not mine?

    Is it a negative listing on your report or just incorrect?

    My problem is I HAVE disputed previously as "Not Mine", ="Verified", etc., etc.,. Now at point where "Previously Investigated" is all I get!!

    "1-2 Punch Time"
    So...I am requesting "Verification/Validation" from CC issuer directly. Then another round of disputes w/CRAs...
    My problem is to submit "additional proof", anything I have, as a statement, etc., shows verifying neg info! I think I have to do some "white out" of sections of statements for submission.

    So, feeling VERY, VERY DUMB right now!!! Never overlook the obvious!!

    At the very least you have the CC company on failing to fully investigate a dispute directed to them through Experian under Section 611 of the FCRA.

    After all, if they fully investigated, they would have seen no such account number exists.

    Or, if one does exist, it obviously isn't yours because your statement shows something different!

    Between a rock and a hard place I would say.......

    P.S. How is it going w/your "excluded/suppressed" item(s)?

    It's been sitting suppressed for 6+ months I think. Experian refuses to delete and continues to verify it.

    I think I disputed the account like 8 times so they won't do any more investigations.

    No other creditors can see it so I figure, I'll just let it sit hidden.

    If it ever comes back, I can always go after the CA for verifying the account 8 times without original account records (UNITED STATES v PERFORMANCE CAPITAL MANAGEMENT INC)

    Sunhawk,

    Following your other thread; are you planning to bring suit against Exp? I am interested as I have another TL that has me ready to file against Exp. Of course I want all my "ducks in a row".

    My case will be very similar to yours, however I am lacking the letter from OC stating they can't validate. I have enough paper trail to show lack of response, and "damages".

    So, I'm very interested in whether you are planning, or undertaking, a suit.....

    Not at this time. Since the line is suppressed, I have no need persue it in a lawsuit.

    However, if it does show back up, I will first go after the CA and then EXP.

    But right now, EXP is not a worry.
