I have been disputing many of the items on my credit files. EQ and EX have been cooperating so far, but TU sent a letter indicating that if I sent them a copy of my BK discharge papers they would clean up my file. My BK was discharged 11/96. There were at least 6 items listed as being discharged thru BK but they weren't my loans. Especially troublesome was at least two home equity secured loans listed. What options do I have? Is it wise to send BK papers to CRA? Joe
I wouldn't send them anything and I think most on this board would agree. The reason is, you may end up verifying something else that would/could hurt you. My suggestion is to have the lawyer that did your bk send them a letter. If not possible, go to another lawyer. The other thing would be to send letters to whoever is reporting the info.
I had the same problem with my BK. My lawyer ( who hates the bureau's ) faxed them only what they needed to do the corrections. It cost me $100, but I think it was money well spent
The problem with giving them schedule F of your bankruptcy papers (I am assuming you filed chapter 7) is that they could add back on any accounts that you have had removed and then they will have proof of the accounts so you would not be able to dispute them. You are saying that there are 6 accounts on your TransUnion report that were never your to begin with and that were not in schedule F of your bankruptcy?
I agree with the others, I wouldn't send them anything. First, I think we should never do their work for them; and secondly, the FCRA does not require you verify your own disputes it requires they investigate. It seems like they are trying to get you to do the investigation for them.
I agree with what has already been said. When I first started my credit repair I noticed a account listed on my TU report as "included in bk-13" or something like that. I sent them a letter saying that it had been over 10 years and to remove it (the company had also gone out of business) They sent me a letter asking for the bk paper so they could verify it. I sent them back a letter stating that it was not my job to verify their information. I also told them that all my documents are in a storage building and I'm not spending a week going through it looking for them, unless I need them for proof in order to sue you for violations of the FCRA.
