TU wont verify!

    They sent me a form letter back saying it was already disputed, and to dispute with the creditor!

    "at your request we previously requested the information which you are currently disputing, and it was verified correct. Therefore we will not be reinvestigating this dispute. if you wish to dispute this information further, you will need to submit new information to us or contact the source of the information directly."

    I had actually sent them a procedure request on how they verified, but this is what they sent back to me. What's my next step??

    Your next step is to send them an intent to sue letter stating that you will be filing based on their willful violation of the FCRA. You are legally entitled to find out what method they used to verify the account if the refuse to comply you will proceed with your lawsuit.

    Thanks robin!

    Does anyone have a sample letter of intent to sue a cra for failure to comply with verification procedure? I the sample letters section and didn't find one.

    From what I understand from other creditnetters, the CRAs get that sort of thing all the time, so I wouldn't even bother with an Intent to Sue...I would just file and have them served. But that's just me. I'm feeling litigious these days...lol.

    Still can't edit...sorry. Also meant to say I would send another procedural request first. A judge could easily see this as an oversight or an error, and not actual negligence or willful on the part of the CRA. If, however, you have several instances, THAT constitutes willful.
