I guess you can say I'm kinda new in that I read a lot of posts and have obtained some really good advice. Here's the deal: Scenario 1: I had an Adelphia Long Distance Account for 3 months back in 2001. Somehow they had a bad address and mail was returned to them. The amount that was accumulated was $46.00 in which I never received a bill. It showed up on my credit report with (I. C. Systems) as of February 2003 as a collection. I found out in June 2003. I called and spoke with a rep who assured me if I paid it they would delete it completely from my CR (wrong). Anyway...what do I do? Scenario 2: I rented an instrument from Mars Music back in 2001, returned it 3 months later as it was broken. Mars went bankrupt and turned over their accounts to Account Management Solutions. They don't have a record of me returning the instrument and I neglected to keep any paperwork. Now they're saying I owe like $500.00 which I refuse to pay. They've threatened to turn it over to a CA in 30 days. What do I do? Itzkimmie
Scenario 1: GET IT IN WRITING before sending a dime. Your account is too small for the CA to spend much time on, but if they didn't put it in writing and you paid them, where is their incentive to follow through? CA's have notoriously short memories when it comes to helping the debtor get the TL off the CRA file if they didn't agree to it in writing beforehand. Scenario 2: As far as FDCPA is concerned, Account Management Systems IS a CA, but if they want to bring in another CA, let them. That gives you FDCPA protections. Send Validation Letter to CA, Dispute as "not mine" with CRA. Dispute, Dispute, Dispute until the CRA labels the dispute frivolous. Then sue the CA.
