First is a validation question. What is considered validation proof from a Ga? I sent a validation request to a CA and all they did was mail me like 4 invoices from the original creditor. Is that validation? Second question is about SOL. Does SOL start at the first delinquent payment date to the original creditor or the date the CA lists it on your credit report? More info about the validation that might help. They didn't send any kind of contract or any documents with my signiture. They only sent copies of the bills that the phone company had sent me 6years and 10 months ago lol. They sent a letter stapled to the copies stating here is your validation of your debt as requested. I'm located in michigan if that helps with the SOL question.
Regarding the validation, this topic has been batted around for years. The short answer is that "pretty much anything" counts as successful validation. From what you described, it sounds as if they have properly validated the debt. Bear in mind that the standards for validation are substantially lower than the standards for evidence in court. SOL starts when the debt first becomes actionable, which is a fancy way of saying that it starts at your first missed payment. If your final payment was made on January 1 2010, and your next payment was due February 1 2010, and your state's SOL is six years, then your SOL will expire between 2/1/16 and 3/1/16, depending on how the judge is feeling that day. You'll want to check caselaw in your locality, as I've seen it go both ways here. Google "Michigan credit card debt statute of limitations" for your SOL.
Thanks that clears up a lot. One more thing. How does it work for your credit report. The seven year listing. My first payment missed was 3-1-04 but the CA opened the listing with the CRA in May of 2006. So when will this come of my credit report?
In theory, it should be based off of the actual delinquency. Otherwise, an OC could keep an entry on your report forever by simply transferring it to different CAs every 7 years. I only say "in theory" because the CRAs appear to be running on full autopilot lately.
