TX Small Claims-- what?!

    Two days ago went to downtown San Antonio courthouse. Was directed to four other buildings before finally arriving at the office where small claims are filed. Then was informed by the clerk that in Bexar county all small claims must be filed in the precinct of the defendant's address-- which means that the courts here will only accept suits against parties located here in Bexar county precincts.

    What a crock!

    Does anyone out there have experience with small claims in San Antonio? From what I've read here on the CN board this doesn't seem possible. Anyone have more info?

    VENUE: A Small Claims Court normally must be filed in the court of the precinct where the Defendant lives. Under some circumstances, you may have a choice of courts in which to bring a claim. For example, if the Defendant lives in one precinct but contracted to perform services in another precinct, either the precinct where the defendant lives or the precinct where the work was performed can be selected as the place to bring suit.


    Did they not send a notice to your house in Bexar?

    I have addressed the same issue with the clerks at my small claims court (TX also). They will let you file it, regardless of jurisdiction questions, and let the judge sort it out. That is what I was told anyhow. Im preparing my suit now, and plan on filing next week. Good luck on yours!
