Unathorized Inq. Lots of questions.

    I am getting ready to file suit against US Bank for an unauthorized inquiry on my report and my husbands. (yes I am positive we didn't authorized these). Is it just 1 violation for both pulls or 2 seperate violations since there was a inquiry on his and on mine even though they were for the same day. I PFB'd them about it and I got the following email about it from Sue Peirce with US Bank:

    We do not have additional information to offer you.
    We assure you that we do not make credit inquiries for reasons that are not legally permissible. Not only would such action go against company policy, there is no incentive to do so. For that reason, we must decline your offer to settle this matter for $1000.00.

    Two days later I get another email from her saying the following:

    We have completed our research into your credit bureau concern.
    We have been able to retract an online credit application from (242425) or someone using his name and personal information. The application
    is was entered on 03/30/2002. Personal information was provided which includes your current email address, 242425's SSN, work and home telephone
    numbers and employer. Your name is listed as "Joint Applicant". The loan was denied because the address supplied did not match that of the address listed with the credit bureau.

    To this day, these inquiries still show up on our reports. So do I have any other violations here other than the no PP? I have already sent a letter to their registered agent and have never received a response. Thank you.

    Probably identity fraud, and You may get them removed, but in that case i doubt that you will get the thousand. If such is the case of identity fraud, fill out the fraudf affadavit and sue em anyhow for reporting it.

    1. Each of your credit files is a separate offense.
    2. Registered Agents never respond to mail, they just pass it along to the company.
    3. Now they are denying credit because addresses don't match what's in teh credit file? I guess taht eliminates the ability to borrow for anyone who moves.

    They never offered me an affadavit to sign. They just said they would be removing it from our reports. That was Nov. 26th, 2003. It still shows up on the reports I pulled this morning. Wouldn't there be some sort of violation there being they said they would remove it and never did?

    This may be an identity theft attempt, and you should report it in case there are more. If so, you will probably not get them on a violation, but they should remove the inquiry and assist you in investigating to find the perpetrator. If you did NOT make an application, file a police report, and notify them that you did not apply. Demand that they remove the inquiries, send you all information they have from the application (so you can determine who may be applying in your name), and that you expect them to cooperate with your investigation. If they do not cooperate, and remove the inquiry, then sue for the non-PP inquiry, and perhaps for negligent enablement of identity theft, for leverage. In some states (such as California) they are required to provide the information they have to assist you in repairing damage from an identity theft.
