Unauthorized iNQ-HELP w/letter

    Last year we found out someone was using my hubby'sname to obtain car loan, so we wrote to that finace company & got the loan clear out from our name, BUT just now I found out they run our report 3 time in April.isnt that a violation worth 3K !!!!
    Please some one gives me an idea how the letter should put together!! Thanks in advance

    I would send a letter like this one:

    January 20, 2002

    XXX
    123 XXXXXX
    XXXXXXX,XX XXXXX

    To Whom It May Concern:

    I am writing this letter because I recently reviewed my credit report from Equifax and it showed an inquiry from your company on XX. I do not recall applying for credit, employment or insurance with your company on this date.

    From the FCRA § 616. Civil liability for willful noncompliance [15 U.S.C. § 1681n]
    "(b) civil liability for knowing noncompliance. Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or $1,000, whichever is greater."

    From the 1998 FTC opinion letter Greenblatt at http://www.ftc.gov/os/statutes/fcra/greenblt.htm
    "Any person who procures a consumer report under false pretenses, or knowingly without a permissible purpose, is liable for $1000 or actual damages (whichever is greater) to both the consumer and to the consumer reporting agency from which the report is procured."

    Please have this inquiry removed immediately. At such time as the inquiry is removed, kindly send me such documentation for my records.

    Your prompt attention to correcting this matter is greatly appreciated, as it is causing me to be wrongfully denied for credit.

    Your failure to acknowledge or respond to this letter within 30 days or by February 19, 2002 will be interpreted as your authorization / instruction for Equifax to delete this inquiry. At that time please arrange for payment in the amount of $1,000.
