Unauthorized inquiry...

    ....from Amica Mutual...

    Just happened to "refresh" my Equifax report...there it is...a "hard" inquiry from this insurance place I inquired to for homeowner's insurance last summer....

    ....now I have a message when I get home (1-800-something) from this company (and agent)...I don't mind solicitation, but keep your &%$%# nose out of my bureau...

    I've already emailed the agent demanding immediate removal...no app to them...no permissable purpose...

    What the hell is this world coming to?

    You didnt handle it as best you could. I suggest you visit bayhouse.com and see how Christine did hers - http://bayhouse.com/credit-forum/showthread.php?s=&threadid=229. I had 4 unauthorized inquiries (2 from Cap One and 2 from an auto dealer in my town which shall remain unnamed). Using the same letters Christine did, I am negotiating a settlement with Cap One for $2000 (rather than for $6000, 2 inquiries each on Equifax, Experian and Transunion). For the auto dealer, I negotiated a little settlement that was more to my liking. I purchased a new 2002 Nissan Xterra for $13,500 instead of the $26,350 sticker price....

    Bayhouse.com lists the law - its $1000 per inquiry made without a permissible purpose.... handle it as you see fit :)

    Good answer. Draft a demand notice to the guy and to the insurance agency. Look up online fcra penalties.

    It's 1000 for the pull, I think 5k for the individual who did it (fine) and jail time. IF you didn't sign an application then they're screwed. get at least 1k cash.

    I now hope these situations come up :_)

    Does this penalty apply only to "hard" pulls? I have soft pulls from cc companies reviewing my credit to see if I qualify for one of their solicitations. I'd always assumed they were allowed to do that -- now I'm wondering if that's not true.

    Only applies to hard pulls. They are allowed the PRM inquiries, unless you have opted out and notified the CRA's. While Equifax will tell you that the inquiries can't be removed (and the law doesn't provide for removal - just a monetary penalty), all of the ones I had were removed by the company that pulled it.

    Can a CA make a hard inquiry? I have one who did that a couple weeks ago -- permitted or not?

    I'd be pissed over this too. You got some good advice about how to take care of it from the other members here. Good luck and may you have a deletion if your story is true.

    Hey I have a problem with your post. I am somewhat new here so I go back and re-read old posts to solve my credit problems and educate myself.

    I noticed that your posts here criticized people who have Bk'd. Then you posted that you and the wife BK'd yourselves.

    You stated that you are an alcoholic on another post.

    You look like a credit card company stooge here. As in someone who makes up BS in order to make everyone seeking legitimate help look bad. You are probably a credit card comapny emplyee.

    'Cheers', well that was a "Cindy" comment on her old posts.

    Unless, you have a good line here, you can kiss my a##. I smell 'Credit card stooge" here.

    Explain yourself dude. And don't be high and mighty. Anyone who reads your old stuff here will catch on.

    I have a nebie question for the group. I have a CA that pulled my file six months after I paid them. - Can they do that, or is that a FCRA violation (and thus meat for my deletion reqest?

    ...anyone ?

    Yep, I'm a stooge--I think I resemble Moe, but the wife insists I'm more a stand-in for Shemp; and, of course, I have credit cards, and THEY probably had credit cards, so I can see the connection...

    You are correct on the CH 13; *as I sit here scratching my head...did I ever say my wife didn't file a CH 13?...how long ago did I first post here? Are opinions/points of view allowed to change? Did I read up on my daily issue of internet bulletin board posting protocols lately? Are those real voices in my head?*

    The "alcoholic" comment was--oh, well, you know--levity? Like, every family has the n'er-do-well, the cousin in prison, a compulsive gambler, the psychic sister-in-law?

    So, I choose to imbibe whilst at the keyboard at home--I'm sorry, what was the nature of your complaint? And where is that damn cocktail waitress?

    A CA can make a hard pull - their 'permissible purpose' is attempting to locate you (or so they say) so they can collect on the debt.

    The person I replied to didn't say the debt had been paid off - he/she just asked if a CA could make a hard inquiry. If the debt is satisfied, the answer is no. But, if the debt is still unpaid, a CA can make a hard inquiry.

    "HARD" are NOT required...

    DISPUTE IT EVERY MONTH TILL THEY REMOVE IT (THEM)...
    "I DID NOT APPLY FOR A LOAN OR CREDIT CARD WITH XYZ COMPANY"
