My friends, I need your help here - if I ever needed assistance I need it now!! My Fiance has worked at a medical facility in Fremont, CA called Crestwood Manor for over three years now - she was just recently fired because of something an employee said she did (which was completely false) The problem is that almost all the employees are Pilipino and they are extremely racist against any other race. Therefore her boss (who is also Pilipino) simply sided with the other employee and called my Fiance a liar - then she was later fired. Needless to say she she is distraught and emotionally drained. BOTTOM LINE: I know she was unfairly terminated and has been misfairly treated by some other employees and the management for some time now (I'll go into details if need be later) I want to start a lawsuit against this facility but the front desk will not give me the name and contact info of the OWNER - do any of you know of a way I can find out? - and do you have any other advice for us that might help us? Sounds like a nursing home - most have to register with the state. Secondly, they are probably incorporated, so you might check with your Sec of State. Don't know if you can find the "owner" of the place (it may be another corporation), but you should be able to find the Agent of Service, and get a letter thru that way. One place to look for "free" help is the EEOC - if you think this is race related. Believe me, I worked for a company on the receiving end of one of their investigations - and they can put that company thru the ringer. We won - but considering she claimed she was terminated due to race, and I was the only one in that company that was not of the race she was, it was kind of funny. Although it was expensive for us to go thru the investigation. Also, has she filed for unemployment? If they are trying to fight an unemployment claim, its a good way to check their pulse.
I agree with jlynn--contact the EEOC. In addition to the federal one, the state probably has one as well. It might be called something else. A case like this could look for a large settlement, when you include the emotional distress, etc. I think I'd look for a good employment lawyer to take this on contingency. Let him find out who to sue. The answer is probably everybody, not just the owners. You would probably name specific employees as well. But they do this all the time. And can probably get you more money, because they'll know all the things to add in. You may end up with more as your share than you would dare to sue for on your own.
jlynn, hedwig, Thanks for your replies. We will contact a lawyer tomorrow. My Fiance is being somewhat hesitant to go ahead with a lawsuit because she keeps thinking she can't possibly win a suit against a company - but I think I convinced her otherwise. Thanks, Sal
