My mother called me told me 4 years ago that her house was going up for auction in 2 weeks .... I did not know she was in that much trouble. Well I was unable to make the back payments for her ...so I recommended that she go chapter 13 (just to stop the auction), and then the house(she wanted to sell it anyway). Well we went to an attorney and filled. The auction was stopped and she sold the the house was sold a few months later. We then withdrew the application for BK. So in essence we only filed never went through the process... with the leftover money she paid off most of her debts and started rebuilding her credit ... about a year ago she went for a car and they told her that she had a BK on her report,she had to pay a higher rate...is there a way to get rid of the BK ... she only filled then withdrew it. so really no BK.. what can she do to remove that.
The filing of the BK is all that counts. Nakes no difference if it went through or if it was canceled . Someone else did have this problem..I do remember it. You might check for the accuracy of the reporting of this..ensure every entry is correct and try to have it removed due to inaccuracies... Good luck!
