Filed my claim a few weeks ago in federal against CRA, in pro se. The law firm assigned to handle the case called this week to discuss a possible settlement. They are really close to their dealine for filing an answer. Hopefully we will settle amicably or otherwise I am prepared to proceed, in which case I will eventually retain counsel. I have kept very meticulous records of the CRA's violations, feel wronged by CRA, and feel very confident in my case. Kind of surprised about the law firm assigned to my case. They seem to be big whigs, one of the largest in the country. I was thinking the firm would be some local rinky dink firm based on other posts. I don't really feel comfortable going up against a firm with vast resources and contacts. Oh well, gotta do what you gotta do. Will post follow-ups. BRCM to the moon!!!!!
I also would be interested in your case. Two CRA's are racking up alot of violation on me. I have one of them on 2 re-insertment violations alone. Keep us informed.
I filed for multiple violations of the FCRA. Various violations from refusing to investigate accounts and inquires, failing to respond to request of procedures used to determine accuracy, claiming to verify what I don't believe they verified, and a few more violations. The violations took place over a long period of time and I finally just god fed up with them and filed. They offered to settle for correcting the accounts/deletions, which I am not accepting. The lawyer stated people frequently sue and are satisified to settle with deletion, but I'm not. I would rather risk losing at trial than accept corrections/deletions at this point. This has gone on for a long time and I believe this CRA routinely violates the FCRA. I just can't accept correction/deletions at this point, I would prefer to go to trial at the risk of losing everything to possibly establish case law against CRA. I am really going to push the inquiry issue, that is that CRA's have an obligation to investigate inquires. BRCM to the moon!!!!!
Also, it did not sound the lawyer had done much of a review of the complaint. It sounded like they just wanted to see if they could make me go away before they filed their answer. AND.....**I think** I was being recorded, although I was't informed the call was being recorded. I kept hearing a clicking sound every few minutes. Something to keep in mind for anyone talking thinking about filing. BRCM to the moon!!!!!
Depending what state you are in, it may very well be legal to record your conversation without telling you. It's called one-party consent with, of course, the lawyer being the consenting party.
